Applicant qualification: Any trademark owner who has used or intends to use a trademark in Malaysian business can apply for trademark registration in Malaysia. If the applicant does not actually use the registered trademark or does not intend to use the registered trademark, he can prove that he has transferred the trademark to a company that will be established and will actually use the registered trademark, or submitted an application for registered users at the same time, then the applicant can submit an application for trademark registration, unless the above-mentioned company has not been established within 6 months from the date of application for trademark registration, then the application will be terminated.
