Article 3 Those engaged in halal food production, operation, and management activities within the administrative area of ??the autonomous region must abide by these regulations. Article 4 The ethnic affairs, food and drug supervision, and industrial and commercial administration departments of the people's governments at or above the county level are responsible for the management and supervision of halal food within their jurisdiction.
The competent departments of health, agriculture, animal husbandry, commerce, housing and urban-rural development, inspection and quarantine, and urban management of the people's governments at or above the county level shall assist in the management and supervision of halal food in accordance with their respective responsibilities. Article 5 People’s governments at all levels should establish and improve halal food supervision and management mechanisms, support the development of halal food and industries with local characteristics, and strengthen the training of halal food production and management talents. Article 6 People's governments at all levels should strengthen the publicity and education of relevant laws, regulations and ethnic policies, and actively guide people of all ethnic groups to respect and tolerate each other.
Any unit or individual should respect the halal eating habits of Hui and other ethnic minorities.
Any unit or individual has the right to report violations of these regulations to the relevant competent authorities. Chapter 2 Management Measures Article 7 The autonomous region implements a quasi-business system for halal food.
Enterprises and individual industrial and commercial households engaged in the production and operation of halal food shall apply for the "Halal Food Permit Business Certificate" and use the "Halal Food Logo" in accordance with the relevant provisions of these regulations, but their names, trade names and trademarks The word "halal" or words and patterns symbolizing the meaning of halal are not allowed. Article 8 The "Halal Food Approval Certificate" is produced under the unified supervision of the ethnic affairs department of the autonomous region and issued by the ethnic affairs department of the city, county (city, district).
No unit or individual may defraud, forge, transfer, lease, or trade the "Halal Food Approval Certificate." Article 9 The "Halal Food Approval Business Certificate" is valid for four years. If production and operating enterprises and individual industrial and commercial households need to extend the validity period, they should submit an application to the original issuing department 30 days before the expiration of the "Halal Food Quasi Business Certificate".
Any production and operation enterprise and individual industrial and commercial household shall not use the "Halal Food Approval Business Certificate" that has expired. Article 10 For an enterprise that applies for a "Halal Food Approval Certificate", the proportion of employees from ethnic minorities such as Hui and other ethnic minorities with halal eating habits to the company's employees shall not be lower than the proportion of the population from ethnic minorities such as Hui and other ethnic minorities with halal eating habits to the total population of the autonomous region. Natural proportion, among which the following personnel must be Hui and other ethnic minorities with halal eating habits:
(1) Persons in charge of production, operation, and catering departments;
(2) Purchasing, Personnel in key positions such as custodial and main production.
For individual industrial and commercial households that apply for the "Halal Food Approval Business Certificate", their owners and main cooking staff must be Hui and other ethnic minorities with halal eating habits. Article 11 Enterprises and individual industrial and commercial households that produce and operate halal food shall apply to the local ethnic affairs department of the city, county (city, district) with the original and photocopy of the identity card of the enterprise’s legal representative or owner and employees. Get the "Halal Food Approval Business Certificate".
All branches, branches or sales points opened by halal food production and operation enterprises that produce and operate halal food must apply for a "Halal Food Approval Business Certificate".
The ethnic affairs department shall issue a "Halal Food Permit Business Permit" to qualified applicants within 20 days from the date of accepting the application. Article 12 Enterprises and individual industrial and commercial households that have obtained the "Halal Food Approval Business Certificate" shall print the "Halal Food Approval Business Certificate" number on their halal food packaging and use the "Halal Food Approval Certificate" produced by the ethnic affairs department of the autonomous region. logo". Article 13 Enterprises and individual industrial and commercial households that produce and operate halal food shall display the "Halal Food Approval Certificate" they have obtained in accordance with the law, and hang the "Halal Food Logo" in a conspicuous position of their production and operation sites.
Shopping malls, supermarkets, etc. that sell halal food should set up a halal food area or counter, and hang the sign of "halal food area (counter)" in a prominent position.
Article 14 Except for the units and places specified in Paragraph 2 of Article 13 of these Regulations, those who have not obtained the "Halal Food Approval Business Certificate" shall not hang the word "halal" or words symbolizing the meaning of halal in their production and business premises. , signboards with graphic marks shall not use halal symbols or words or patterns symbolizing halal meaning on the products and packaging they produce.
It is prohibited to use the word "halal" in conjunction with the names of foods tabooed by ethnic minorities such as the Hui who have halal eating habits as signboards of production and business premises. Article 15 Enterprises and individual industrial and commercial households that produce and operate halal food shall carry out production and business activities in accordance with the halal eating habits of the Hui and other ethnic minorities, and conduct halal food management laws and regulations, ethnic policies, and the policies of the Hui and other ethnic minorities on their employees.
