Duration of protection of geographical indications
Is there a time limit for the protection of geographical indications?

The provisions of the three geographical indications are not quite the same. Let's take a look at their respective rules.

The Regulations on the Protection of Geographical Indication Products does not stipulate the protection period of geographical indication products, nor does it stipulate the withdrawal mechanism. It can be considered that the protection of geographical indication products has no time limit.

According to the provisions of the Trademark Law, geographical indication certification trademarks and collective trademarks are only one kind of trademarks. A registered trademark is renewed every ten years, and it will no longer be protected if it is not renewed. There are many examples of geographical indication trademarks being invalid because they have not been renewed. Geographical indication trademarks have a term of protection, but they can be extended indefinitely.

Among the three geographical indications, the geographical indication of agricultural products is the most clear. Article 13 of the Measures for the Administration of Geographical Indications of Agricultural Products stipulates that "the registration certificate of geographical indications of agricultural products shall be valid for a long time". Moreover, the withdrawal mechanism is stipulated, and the Measures for the Administration of Geographical Indications of Agricultural Products stipulates that the registration certificate of geographical indications can be cancelled.

In summary

Generally speaking, the protection of geographical indications is long-term.

However, the trademark of geographical indications must be renewed, and the geographical indications of agricultural products may also be cancelled.
