First, how to punish the infringement of trademark rights of others?

1, the punishment for infringing the trademark rights of others is as follows:

If the infringement of the exclusive right to use a registered trademark does not constitute a crime, the administrative department for industry and commerce may, according to the circumstances, impose a fine of less than 50% of the illegal business amount or less than 5 times the profit from the infringement; If a party refuses to accept the above two treatments, he may bring a lawsuit to the people's court in accordance with relevant laws and regulations within 15 days from the date of receiving the notice;

2. Legal basis: Article 57 of People's Republic of China (PRC) Trademark Law.

(2) Without the permission of the trademark registrant, using a trademark similar to its registered trademark on the same kind of goods, or using a trademark identical with or similar to its registered trademark on similar goods is likely to cause confusion;

(4) Forging or unauthorized manufacturing of registered trademark marks of others or selling forged or unauthorized registered trademark marks;

(five) without the consent of the trademark registrant, the registered trademark is changed and the goods with the changed trademark are put on the market again;

(6) Deliberately facilitating the infringement of the exclusive right to use a trademark of others and helping others to commit the infringement of the exclusive right to use a trademark;

(seven) causing other damage to the exclusive right to use a registered trademark of others.

Second, the effective period of the trademark right is several years.

The term of validity of a trademark right is ten years, generally counting from the date of approval and registration by the Trademark Office. If you want to apply for renewal, you must apply directly to the Trademark Office 12 months before the expiration. If you don't apply, you can postpone it for six months.
