How long is the trademark valid?
The trademark is valid for ten years. If a registered trademark needs to be used again after the expiration of its validity period, it may be renewed in accordance with the provisions. The trademark registrant shall, within 12 months before the expiration of the validity period. If the renewal formalities are not completed within the time limit, a grace period of six months may be given. The validity period of each renewal registration is ten years, counting from the date when the last validity period of the trademark expires. If the renewal formalities are not completed within the time limit, the registered trademark will be cancelled.

Materials required for applying for trademark registration:

1. Domestic legal person or other organization: Copies of valid certificates such as business license, legal person registration certificate certificate, certificate of legal person of public institution, certificate of legal person of social organization, practice certificate of law firm, practice license of medical institution, etc., and certificates such as school license, periodical certificate and organization code certificate cannot be used as identification documents of the applicant;

2. Domestic natural persons: submit copies of valid identity documents such as identity cards, passports and household registration certificates, as well as copies of business licenses of individual industrial and commercial households or rural land contract management contracts. The scope of goods and services that a natural person applies for trademark registration is limited to the business scope approved by its business license or relevant registration documents, or to the self-operated agricultural and sideline products;

3. Legal persons or other organizations from Hong Kong, Macao, Taiwan or abroad: A copy of the registration certificate of the region or country to which they belong shall be submitted. Copies of the registration certificates of foreign enterprises' offices and resident representative offices in China are invalid. If the above documents are in a foreign language, a Chinese translation shall be attached; If it is not attached, it shall be deemed that the document has not been submitted;

4. Hong Kong, Macao and Taiwan natural persons shall handle it themselves: submit a copy of their passports; If the applicant is a foreign natural person and handles it on his own, he shall submit a copy of his passport and a certificate issued by the public security department.

Legal basis: Article 39 of the Trademark Law of People's Republic of China (PRC).

The period of validity of a registered trademark is ten years, counting from the date of approval of registration. Article 40 Where a registered trademark needs to be used continuously after the expiration of its term of validity, the trademark registrant shall go through the renewal procedures in accordance with the provisions within 12 months before the expiration; If it has not been handled during this period, it can be extended for six months. The validity period of each renewal registration is ten years, counting from the day after the last expiration of the trademark. If the renewal formalities are not completed at the expiration of the period, the registered trademark shall be cancelled. The Trademark Office shall announce the renewed registered trademark.
