Legal analysis: Step 1: Applicant submits an application
The applicant submits an Application for Revoking the Discontinuation of the Use of a Registered Trademark for Three consecutive Years to the Trademark Office, and gives a written explanation of the "non-use" of the trademark;
Step 2: After accepting
the application for three-year non-use, the Trademark Office issues a Notice on Providing Evidence of the Use of a Registered Trademark to the registrant, requiring the registrant to submit evidence of the actual use of the registered trademark within two months from the date of receiving this notice;
Step 3: The registrant submits the use evidence on schedule
After receiving the evidence materials, the Trademark Office will conduct evidence review and fact determination. If it is found that the evidence can prove that the registered trademark has been actually used within the specified period of 3 years, a "decision on the continued validity of the trademark note" will be issued, otherwise, a "decision on the cancellation of trademark registration" will be issued;
Step 4: file an application for revocation review
Legal basis: Article 66 of the Trademark Law of the People's Republic of China states that a registered trademark specified in Article 49 of the Trademark Law has not been used for three consecutive years without justifiable reasons, and any unit or individual may apply to the Trademark Office for revocation of the registered trademark, and the relevant information shall be explained when submitting the application. After accepting the application, the Trademark Office shall notify the trademark registrant to submit the evidential materials used before the application for revocation of the trademark or explain the legitimate reasons for not using it within two months from the date of receiving the notice; If the evidential materials for use are not provided at the expiration of the period or the evidential materials are invalid without justifiable reasons, the Trademark Office shall revoke its registered trademark.
