Answer: Gu'an Huaxia is still at odds with COFCO
In May 2012, COFCO purchased the "Huaxia Pearl" wine at the "Liquor and Tobacco Supermarket" run by Mr. Zhao. The product is marked with the four words "Huaxia Pearl" on the left side of the package, in which the word "Huaxia" in larger font is prominently used as a trademark, which is exactly the same as the "Huaxia" registered trademark No. 4443289 owned by COFCO.
COFCO Group believes that Mr. Zhao’s behavior is an attempt to use the high visibility and high brand value of COFCO Group’s trademarks to promote its own products in order to confuse consumers’ perceptions and seek unfair benefits. At the same time, as a seller specializing in tobacco and alcohol, Mr. Zhao neglected to fulfill his obligation to review the manufacturers, trademark certificates and other licenses of the goods he sold, and even knowingly sold the goods sold as infringing goods, his subjective intention was obvious. Therefore, the lawsuit was filed in court, requiring Mr. Zhao to immediately stop the infringement and compensate COFCO Group for economic losses and reasonable expenses totaling RMB 30,000.
