Article 37 Local financial departments shall allocate working funds to strengthen the publicity of the policy of home appliances going to the countryside, business training, sales outlet supervision, township The Finance Office shall review and redeem subsidy, supervise and inspect, publicize and purchase necessary equipment, etc. The central government arranges work funds and provides appropriate subsidies to local governments.

Article 38 For sales outlets that undertake agency review work in pilot areas for fiscal subsidy review and redemption reform, the central government will provide a fixed subsidy of 0.5 yuan per product based on the number of agency review products. Sales outlets undertaking agent review work are not allowed to charge farmers any fees other than the product itself.

Article 39: Financial departments at all levels must support the establishment and improvement of a distribution network for home appliances to the countryside based on their financial resources. The central government will provide appropriate incentives to various localities for improving the distribution network of home appliances to the countryside.

Chapter 9 Legal Responsibilities

Article 40: For enterprises whose product quality is unqualified, quality supervision and other departments at all levels shall immediately order them to make corrections within a time limit, recall unqualified products, and promptly Publish relevant information to the public.

Punishments such as withholding deposits, suspending or canceling bid-winning qualifications will be implemented for winning bidders that fail to fulfill their quality commitments and have outstanding product quality problems. Penalty decisions are made and announced by the Ministry of Finance, the Ministry of Commerce, and the General Administration of Quality Supervision, Inspection and Quarantine of the Ministry of Industry and Information Technology.

Manufacturing enterprises that fail to pass the quality supervision and spot inspection at or above the provincial level and still fail to pass the rectification and re-examination, fail to pass the supervision and inspection of product quality and safety items, and intentionally violate the laws and regulations will be included in the product quality credit as seriously untrustworthy enterprises. Record network, quality supervision department should investigate and deal with it in accordance with the law, revoke the license or CCC certification, and report to the local government in a timely manner.

Article 41: For sales companies that fail to fulfill their bidding commitments and bid-winning agreements, or have outstanding sales and service problems, they will be subject to penalties such as withholding deposits, suspending or canceling the bid-winning qualifications of home appliance circulation companies going to the countryside, and the penalties will be decided by Made and announced by the Ministry of Finance, the Ministry of Commerce, the Ministry of Commerce, Industry and Information Technology, and the State Administration for Industry and Commerce.

Article 42 If any of the following bad behaviors from Items (1) to (3) occur at a sales outlet, the local commerce department shall immediately order it to make corrections within a time limit; if no correction is made within the prescribed time limit, the county-level The competent commerce department should suspend the qualification of its home appliance sales outlets in the countryside. If a sales outlet engages in the following serious bad behaviors (4) to (8), or if bad conduct occurs more than three times in total, the county-level commerce department shall immediately cancel its qualification as a sales outlet for home appliances going to the countryside:

( 1) There is no bulletin board for home appliances going to the countryside and instructions for farmers to purchase them in the store.

(2) Failure to issue invoices to purchasing farmers within the specified time, and failure to timely enter the sales information of home appliances to the countryside products into the home appliances to the countryside information management system, causing farmers to delay or be unable to apply for subsidies.

(3) Failure to respond to farmers’ service requirements in a timely manner and delaying for various reasons violates the state’s “Three Guarantees” regulations on home appliances.

(4) Extract product identification cards and sell home appliances to the countryside products as non-home appliances to the countryside.

(5) Changing the models of home appliances going to the countryside without authorization, or selling non-home appliances going to the countryside products in the name of home appliances going to the countryside.

(6) False propaganda, misleading or deceiving farmers during the sales process of home appliances to the countryside.

(7) Failure to comply with the price regulations for home appliances sent to the countryside, and the terminal sales price is higher than the winning bid price.

(8) Keep identification cards privately, keep or copy farmers’ household registration books, ID cards and other relevant information for receiving subsidies, enter false purchase information, etc., to defraud subsidies.

In the process of selling home appliances to the countryside, any losses incurred by the purchasing farmers due to bad behavior at the sales outlets will be fully borne by the relevant winning bidders.

Article 43 Sales outlets that act as agents to examine subsidy funds for home appliances going to the countryside shall keep the purchaser’s household registration book, ID card, savings passbook and other basic information strictly confidential and shall not disclose it. If improper management causes economic losses to purchasing farmers, the economic losses will be compensated and relevant responsibilities will be held in accordance with relevant laws and regulations.

Article 44 If operators of home appliances to rural areas violate price laws and regulations, the government’s price department will impose administrative penalties in accordance with the law.

Article 45 Anyone who defrauds financial subsidies for home appliances going to the countryside will be dealt with in accordance with the "Regulations on Penalties for Fiscal Illegal Acts" (State Council Order No. 427).

Chapter 10 Supplementary Provisions

Article 46 These detailed rules shall be implemented from the date of issuance. If previous regulations are inconsistent with these rules, these rules will apply. Each locality may formulate specific implementation measures based on these detailed rules.

Article 47 These detailed rules shall be interpreted by the Ministry of Finance in conjunction with the member units of the Joint Conference of Home Appliances to the Rural Areas.
