1. The trademark owner shall be an organization with the ability to supervise a certain commodity or service;

2. The trademark owner must be a legally registered enterprise or institution with legal personality;

3. The trademark owner must have the applicant's main qualification certificate issued by the local administrative department for industry and commerce, that is, the legal document that the applicant is registered according to law and has the legal person qualification.

Article 4 of the Trademark Law of People's Republic of China (PRC)

If a natural person, legal person or other organization needs to obtain the exclusive right to use a trademark for its goods or services in production and business activities, it shall apply to the Trademark Office for trademark registration. The application for registration of a malicious trademark that is not intended to be used shall be rejected.

The provisions of this Law on commodity trademarks shall apply to service trademarks.

Article 5 of the Measures for the Administration of the Registration of Collective Trademarks and Certification Trademarks

Where an applicant applies for the registration of a certification trademark, it shall attach the qualification certificate of the subject, and explain in detail the professional technicians and professional testing equipment it owns or the institutions it entrusts, so as to show that it has the ability to supervise the quality of the specific goods certified by the certification trademark.
