Cross-category protection of well-known trademarks

Legal analysis: Cross-category protection refers to the cross-category protection implemented by the state for registered well-known trademarks, also known as "absolute protection". The existing laws have made it clear that the protection of well-known trademarks is not limited to cross-class protection, that is, ordinary registered trademarks are imitations of registered well-known trademarks on the same or similar goods, which constitutes trademark infringement. According to the relevant laws and regulations, unregistered well-known trademarks are protected as ordinary registered trademarks, and registered well-known trademarks are protected across categories.

Legal basis: Article 13 of the Trademark Law of the People's Republic of China is a trademark that is well known to the relevant public. If the holder thinks that his rights have been infringed, he may request the protection of well-known trademarks in accordance with the provisions of this law. A trademark applied for registration of the same or similar goods is a well-known trademark copied, imitated or translated by others that is not registered in China, which may easily lead to confusion, so it shall not be registered and its use shall be prohibited. Where a trademark applied for registration of a different or dissimilar commodity is a well-known trademark that has been registered in China by others, which misleads the public and may damage the interests of the registrant of the well-known trademark, it shall not be registered and its use shall be prohibited.
