Disputes can be raised over successfully registered trademarks: trademark disputes refer to disputes over registered trademarks, that is, disputes over trademark rights between two registered trademark owners because two trademarks are identical or similar in the same or similar goods/services, or disputes over trademark rights between well-known trademark owners because a registered trademark is identical or similar to a well-known trademark. Article 4 1 of the Standard Law (Second Revision): "In case of any dispute over a registered trademark in ..., you may apply to the Trademark Review and Adjudication Board for adjudication within five years from the date when the trademark is approved for registration." The registered trademark dispute mentioned here refers to the dispute caused by the trademark registrant's earlier registered trademark being the same as or similar to the trademark registered by others on the same or similar goods. Therefore, the essence of trademark dispute is that the disputing party thinks that the later registered trademark conflicts with its earlier registered trademark rights and interests.
That is, it is identical with or similar to a previously registered trademark on the same commodity or similar commodities, or it has caused misunderstanding among consumers in the market, and therefore proposes to limit the scope of use of the trademark or cancel the registration of the trademark.
