What is trademark correction? How to apply and process?

Trademark application supplementation means that the National Trademark Office makes suggestions for modifications to the trademark registration application that do not comply with the relevant provisions of the "Trademark Law". The purpose is to make the revised trademark registration application comply with the "Trademark Law" Regulation. Generally speaking, the Trademark Office requires corrections because when you submitted your trademark application, the application procedures were basically complete or the application documents basically complied with the regulations, but some content or written materials did not meet the requirements. The Trademark Office will issue a "Notice of Supplement and Correction of Trademark Registration Application", which requires the applicant to make corrections according to the specified content and return it to the Trademark Office within 30 days from the date of receipt of the notice. If corrections are made and returned to the Trademark Office within the prescribed time limit, the application date will be retained; if corrections are not made within the time limit or corrections are not made as required, the application will not be accepted. The aforementioned application procedures are basically complete or the application documents are basically in compliance with the regulations but need to be supplemented and corrected generally include the following situations:

(1) The name of the product/service item reported is not standardized and specific;

(2) The reported product/service names do not belong to the same category;

(3) The trademark image is not clear;

(4) The text in the trademark image needs to be modified Explanation;

The reply to the "Notice of Supplement and Correction of Trademark Registration Application" is a very important link that applicants and agents should pay attention to. If handled improperly, it will not only affect the review process of the application, but may even cause the application to be invalid. Therefore, please pay attention to the following points when replying:

(1) Use a printer to print the supplementary content at the corresponding location on the "Notice of Supplement and Correction of Trademark Registration Application".

(2) If the goods or services need to be deleted, the words "agree to delete" should be marked to confirm the deletion.

(3) The corrected goods or services shall be limited to the corresponding scope of the original goods or services requiring correction, and shall not be arbitrarily changed or added.

(4) The revised goods or services should correspond one-to-one with the goods or services before the revision to facilitate the continuation of the review work.

(5) If there is a lot of correction content that cannot be written on the correction notice, you can directly add an attachment (A4 paper) and indicate in the correction column: "There is an attachment" or "See the attachment" ?The wording is more stable.

(6) If a blank correction notice is returned, the Trademark Office will regard the applicant or agent as giving up the project.

(7) The agency seal and stamp should be uniformly located on the lower right side of the supplemented and corrected content, and the stamp should not cover the supplemented and corrected content.
