At the same time, the "Standards" separately explain the examination standards for trademarks that are the same as or similar to the names of foreign countries and the examination standards for trademarks that are the same as or similar to the names or patterns of foreign flags, national emblems, and military flags. 1. If a trademark is the same as or similar to the name of a foreign country, and the text composition of the trademark is the same as the name of the foreign country, it will be determined to be the same as the name of the foreign country. If the words of a trademark are similar to the name of a foreign country or contain words that are the same as or similar to the name of a foreign country, it will be determined to be similar to the name of the foreign country. Exceptions are made under one of the following circumstances: (1) With the consent of the government of the country. To apply the provisions of the Standards, the applicant should submit written certification approved by the government of the country. If the applicant has obtained registration of the trademark in the foreign country, the foreign government shall be deemed to have consented. (2) It has a clear other meaning and will not cause public misunderstanding. (3) The trademark is the same as or similar to the old name of the foreign country. However, if it is likely to cause the public to misunderstand the origin of the product, it will be judged to have adverse effects, and the provisions of the Trademark Law "harmful to socialist morals or have other adverse effects" will be rejected. (4) The words of the trademark are easily made by the public to think that they are a combination of two or more abbreviations of Chinese country names, and will not cause the public to misunderstand the origin of the goods. However, if it is easy for the public to misunderstand the origin of the product, it will be judged to have adverse effects, and the provisions of the "Trademark Law" that "are harmful to socialist morals or have other adverse effects" will be rejected. (5) The trademark contains words that are the same as or similar to the name of a foreign country, but the entire trademark is the name of the enterprise and consistent with the name of the applicant. (6) The country name contained in the trademark is independent of other signs with distinctive characteristics, and the country name only serves the purpose of truly indicating the applicant's country of origin. 2. The trademark is the same as or similar to the name or pattern of a foreign national flag, national emblem, or military flag. The words, graphics, or combination of the trademark is identical to or similar to the name or pattern of a foreign national flag, national emblem, or military flag, which is enough to cause the public to associate it with a foreign national flag, national emblem, or military flag. If it is related to the national emblem, it will be determined to be the same as or similar to the national flag or national emblem of a foreign country.
