Article 11 of the "Trademark Law of the People's Republic of China" stipulates that the following signs shall not be registered as trademarks:
(1) Only the common name and graphics of the product , model;
(2) Only directly indicating the quality, main raw materials, functions, uses, weight, quantity and other characteristics of the goods;
(3) Other lack of distinctive features of.
If the signs listed in the preceding paragraph acquire distinctive features through use and are easy to identify, they may be registered as trademarks.
Judging from the signs listed in the "Trademark Examination Guidelines", the signs in Article 11, Paragraph 1, Item 3 of the "Trademark Law" mainly include two types. The first is that the sign itself is too simple. Or it is too complicated and difficult for consumers to remember, and therefore does not have the distinctive features of the trademark. The second type is a mark that is usually regarded by consumers as having other functions than being used as a trademark to identify the source of goods. Relatively speaking, the first type of logo is easier to judge objectively, and it also has relatively stable standards. However, the second type of signs will change due to changes in social perceptions and market practices.
