Can a trademark transfer application be withdrawn?

Yes. Before the transfer application is approved by the State Intellectual Property Office, if both parties to the transfer and the transferee reach an agreement, they may apply for withdrawal. If the transfer is handled through an agency, the withdrawal procedures should be handled through the original agency.

Materials required for withdrawing transfer application:

(1) "Withdrawal of Assignment/Transfer Application/Application for Registered Trademark";

(2) Assignor and a copy of the transferee’s identity document confirmed by stamp or signature (such as a copy of the enterprise’s business license, natural person’s ID card/residence permit for Hong Kong and Macao residents/residence permit for Taiwan residents/passport, etc.);

(3) If a trademark agency is entrusted to handle the matter, submit a power of attorney issued by both the transferor and the transferee;
