Chanel sued Huawei logo. Will Chanel appeal after losing the case?
The trial of cases in our country adopts the second-instance and final-instance system. That is to say, if a party appeals after losing the first-instance case, then the hearing after the appeal is already final and no appeal can be made again.
Chanel believes that the logo applied by Huawei for its computer hardware in the EU is too similar to its logo. In 2017, Huawei applied for EU trademark protection for its logo used on computer hardware. This move was opposed by Chanel, saying that the two intertwined half-rings (Huawei's logo) are similar to its protected logo, which has been used by Chanel in products such as cosmetics, perfumes and clothing.
Since then, the Trademark Office rejected Chanel’s objection in 2019, saying that there was no similarity and it was not likely to cause confusion in the public mind. Chanel subsequently challenged the ruling again in a Luxembourg court, which dismissed its appeal in a ruling on Wednesday, with the EU General Court ruling that the disputed trademarks had some similarities but that their appearance was significantly different. ?
