The trademark owner must submit a trademark use statement in the fifth to sixth years from the date of registration. For example, if the registration date is 20 1 March 6 1, the trademark owner must submit the use statement for the period from March 20265438 to March 20221. If the declaration of use submitted conforms to the law, the trademark registration shall remain valid within the validity period.
The second application for trademark use statement and renewal application shall be submitted between the ninth year and the 10 year from the date of registration. For example, if the registration date is March 20 16 1 day, the trademark owner must submit the use statement and renewal application from March 2025 1 day to March 2026 1 day, and pay the corresponding fees. If the use statement and the application for renewal comply with the law, the trademark registration will continue to be valid in the next 10 year.
From the second 10 year after registration: submit a statement of use.
Except for the first year 10, the trademark owner must submit the trademark use statement and renewal application between the start date 10 and the ninth year 10, and pay the corresponding fees. If the use statement and the application for renewal comply with the law, the trademark registration will continue to be valid in the next 10 year.
If the trademark owner fails to submit the declaration of use or the application for renewal within the above period, he must submit the corresponding documents and pay the corresponding renewal fee within 6 months from the date of expiration of the period.
For trademark owners who enter the United States through Madrid, the renewal and extension period are consistent with the direct application, but the application for renewal must be submitted to the World Intellectual Property Organization.
