1. Copyright
Some Olympic symbols have the properties of works and are protected by the Copyright Law of the People's Republic of China. On December 15, 2017, the Beijing Winter Olympics Organizing Committee completed the copyright registration of the "Beijing 2022 Winter Olympics Emblem" and other Olympic symbols at the China Copyright Protection Center. During the preparation and hosting of the Beijing Winter Olympics, a large number of communication carriers involving Olympic symbols will be generated. Unauthorized use of the above logos will constitute infringement of Olympic logo copyright.
2. Trademark Rights
Since the preparations for the 2014 Beijing Winter Olympics, the Beijing Winter Olympics Organizing Committee has submitted to the Trademark Office of the State Intellectual Property Office, including the Beijing Winter Olympics More than 2,000 domestic and foreign trademark registration applications, including emblems, mascot images, slogans, related Chinese and English names, etc., involving all goods and services in categories 1 to 45. Unauthorized use of the Olympic logo as a trademark will constitute an infringement of trademark rights.
3. Patent rights
At the same time as the Beijing Winter Olympics emblem and mascots were announced, the Beijing Winter Olympics Organizing Committee submitted Olympic patents including the emblem, mascots, etc. to the National Intellectual Property Office. 8 design patent applications including related images including logos. These logos are protected by the Patent Law of the People's Republic of China.
Appearance design must be based on products. Olympic symbols protected by design patents mainly include emblems, mascot images, torches, etc. With the expansion of the expression forms of the Olympic logo, the types of design patents that right holders can apply for are becoming increasingly diverse, usually including: labels, signboards, graphical user interfaces (GUI), etc. Unauthorized use of the Olympic Marks will constitute patent infringement.
4. Anti-unfair competition
In some market operations, there will be hidden marketing behaviors that use the Olympic logo to "free ride". This type of behavior does not directly use the Olympic logo, but uses the names of congratulations, cheers, celebrations, countdowns, announcement of competition results, award lists, naming promotion, etc. to mislead the public into thinking that there is a specific relationship with the owner of the Olympic logo. . The "Regulations on the Protection of Olympic Symbols" revised in 2018 specifically added provisions to regulate hidden marketing. This type of behavior can be held accountable through the relevant provisions of the "Law of the People's Republic of China and the State Against Unfair Competition".
