The trademark dispute between the two brands began, and the trial lasted for one year. In the end, the court determined that the duck products and other related products sold by Beijing Chang Xiangda constituted the same or similar products as the products approved for use in the disputed trademark. Beijing Changxiangda’s behavior may easily cause the relevant public to misunderstand the source of the goods. Beijing Chang Xiangda’s behavior violated the provisions of the Trademark Law, which constituted the use of a trademark similar to the disputed trademark on similar goods without the permission of Zhejiang Dingyu Company, which could easily lead to public confusion. Therefore, Beijing Chang Xiangda Company's behavior infringed upon Zhejiang Dingyu Company's registered trademark exclusive rights and should bear corresponding infringement liability. Beijing Changxiangda shall compensate Zhejiang Dingyu for economic losses of RMB 10,000 and reasonable expenses of RMB 3,000 within ten days from the date the judgment takes effect. For this reason, "Jiujiuya" also applied for trademarks such as Jiujiu Chicken and Jiujiu Goose.
