Legal analysis: The trademark applied for registration should have distinctive features that are easy to identify, which is determined by the identification function of the trademark. When a trademark is used in the market, it should be obvious to consumers that it is a trademark rather than decoration or description. According to the relevant laws and regulations of our country, if the product only directly expresses the quality, main raw materials, functions, uses, weight, quantity and other characteristics of the product, it shall not be registered as a trademark if it lacks distinctive features.

Legal basis: Article 11 of the Trademark Law of the People's Republic of China. The following signs shall not be registered as trademarks: (1) Only the common name, graphics and model of the product; (2) ) Only directly express the quality, main raw materials, functions, uses, weight, quantity and other characteristics of the goods; (3) Other lack of distinctive features. If the signs listed in the preceding paragraph acquire distinctive features through use and are easy to identify, they may be registered as trademarks.
