Recently, the Beijing Intellectual Property Court accepted the trademark invalidation request of Changjiang Dragon New Media Co., Ltd. and Ende Moshang Culture Media Co., Ltd. for the "Most Powerful Brain" trademark.

Changjiang Dragon stated that it applied for registration of "The Strongest Brain" to the Trademark Office of the State Administration for Industry and Commerce in November 2013, and the registration was approved in February 2015. It is approved for use in Category 41 education, training, program production and television entertainment programs and other services. The trademark is valid until February 2025.

Endemoshang Company filed an application for invalidation of the disputed trademark in April 2017. The Trademark Review and Adjudication Board determined that the trademark right of “The Strongest Brain” is invalid.

There are two reasons: First, "The Most Powerful Brain" has a high reputation in the market and has a certain influence. However, Yangtze Dragon Company still registered the trademark "The Most Powerful Brain" in Class 41, which damaged the prior rights and interests enjoyed by Endemoshang Company in the well-known trade name of "The Most Powerful Brain". Second, Endemoshang Company violated the relevant provisions of the Trademark Law regarding "The Strongest Brain".

The court ruled that the reasons for the invalidation of Ende Moshan Company were partially established. The disputed trademark was declared invalid for radio and television program production, program production, and television entertainment program services, and was maintained for other services.

Both companies expressed dissatisfaction and sued the Beijing Intellectual Property Court.

Endemoshang Company believes that Changjiang Dragon Company’s trademark registration of “The Most Powerful Brain” is an act of squatting. The Yangtze River Dragon Company stated that Endemoshang Company was neither the prior right holder nor an interested party, and had no right to file an invalidation application for "The Most Powerful Brain". Moreover, when the Yangtze River Dragon Company registered the "The Most Powerful Brain" trademark, the program also If it has not reached a level of popularity, there is no way to register a trademark by taking advantage of the popularity of the program.

Currently, the case is still under trial, and the final fate of the "most powerful brain" remains to be considered.
