Can the trademark be renewed?
Yes, Article 40 of the Trademark Law of People's Republic of China (PRC) stipulates that if a registered trademark needs to be used after its expiration, the trademark registrant shall go through the renewal procedures in accordance with the regulations within 12 months before the expiration; If it has not been handled during this period, it can be extended for six months. The validity period of each renewal registration is ten years, counting from the day after the last expiration of the trademark. If the renewal formalities are not completed at the expiration of the period, the registered trademark shall be cancelled. It is worth mentioning that the application for renewal is different from the initial application for trademark registration. The purpose of applying for renewal is to make the exclusive right to use a trademark that has been obtained continue to be valid through the application, not to make the newly registered trademark obtain the exclusive right. Therefore, the procedure for applying for renewal is also very simple. The materials to be submitted are: the original or photocopy of the renewed trademark registration certificate; 6. A copy of the trademark pattern consistent with the trademark pattern of the original registration certificate; Copy of the business license of the enterprise. As long as the trademark registrant applies within six months within the time limit prescribed by law and pays the prescribed fee, it can be allowed to renew the registration according to law.
