The Trademark Office has announced the trademark transfer. Can it be revoked?
Trademark revocation refers to the procedure that the State Trademark Office or the Trademark Review and Adjudication Board makes a decision or ruling on acts that violate the Trademark Law and relevant provisions, so as to eliminate the exclusive right to use the original registered trademark. According to the provisions of Articles 41, 44 and 45 of China's Trademark Law, the Trademark Office or the Trademark Review and Adjudication Board may rule or order the cancellation of a registered trademark for legal reasons.

Trademark revocation process

1, processing method

There are two ways to apply for canceling the use of registered trademarks for three consecutive years:

(1) Entrust a nationally recognized trademark agency to handle it.

(2) The applicant goes directly to the trademark registration hall of the Trademark Office.

2. Processing steps

(1) Where a trademark agency is entrusted, the applicant may voluntarily choose a trademark agency recognized by the state to handle it. All trademark agencies registered in the Trademark Office are published in the column of "Agencies".

(2) Where the applicant directly goes to the trademark registration hall, the applicant may follow the following steps:

Prepare the application → submit the application in the acceptance window of the trademark registration hall → enter the receipt barcode in the coding window → pay the application fee in the payment window → check whether to cancel the registered trademark.

note:

1. The applicant's name, address, postal code, telephone number and other contact information must be clearly and accurately filled in for easy contact.

2. Before submitting the application, the applicant shall inquire about the registration of the revoked trademark, and fill out the Application for Revocation of Stopping Using the Registered Trademark for Three Years in a row according to the current registrant of the trademark.

3. It has been 3 years since the date of approval and registration of the trademark for cancellation.

4. If the Trademark Office revokes the registered trademark, the trademark registrant may apply to the Trademark Review and Adjudication Board for reexamination within 15 days from the date of receiving the revocation decision.
