In fact, on the issue of the protection of traditional culture, the Chinese government is not doing nothing, but gradually trying to collect, sort out, preserve and record the folk literature and art, traditional knowledge and intangible cultural heritage. While the traditional culture is sleeping in the cradle of the government ...
It was not until Mulan went to Hollywood to make a movie and the Monkey King went to Japan to play games that China's traditional culture woke up from a dream: while discovering its huge commercial value, it was painfully caught in the "international trap" set by developed countries and reflected on the defects of the current cultural protection and utilization mechanism.
traditional culture is the source of knowledge innovation, and it is spread by means of knowledge products. Developed countries are poor in traditional cultural resources, but strong in innovation ability and rich in knowledge products, which control the global high-tech industries and cultural sunrise industries. Because the development of these industries benefits from high-intensity intellectual property protection, developed countries are committed to maintaining the "flow" of "knowledge products" in their leading international conventions on intellectual property rights, while letting the "source" of traditional culture be polluted, forming an international rule that "intellectual property protection innovation results do not protect intellectual sources". Under this "guise", the source of intelligence has quietly flowed from the East to the West, and culture has also moved from tradition to modernity. However, developing countries, including China, are still in the dark, thinking that folk songs can only be sung in the mountains, and the three countries are only in books, and genes are just attached to the body. What commercial benefits are there? In the absence of incentive mechanism for cultural and folk inheritance, the government has to step forward and act as a "civilized messenger". Unfortunately, in the officialdom that advocates GDP figures, the historical aura of "civilized emissary" is brilliant enough, and it will not be a performance project. The government is quite rational in its budget for protecting traditional culture. As a result, the "flow" of knowledge products has not been intercepted, and the "source" of traditional culture has not been kept.
it must be noted that the "solid source" of traditional culture needs the power of administration, but also the oil of interests. The water source of culture comes from the people and flows to the people. Only when the interests are driven to form a joint force can the blowout be realized. In other words, the protection of traditional culture with the help of the people depends on reasonable interest incentives, and it is imperative to establish a benefit-sharing mechanism between intellectual property owners, folk literature and art inheritors and holders of traditional cultural resources. In fact, as early as 1992, the National Copyright Administration began the legislative investigation of the Regulations on Copyright Protection of Folk Literature and Art Works, and the first draft was formed in 1996. However, due to the collective, regional and generational characteristics of folk literature and art works, it is difficult to distribute interests reasonably, and the legislative work is facing great challenges. Although the regulations have been revised repeatedly and promoted several times, they are still in a state of dystocia, and the date of their birth is worth our expectation. At the same time, developing countries, including China, should not fall into the "international trap" of developed countries again, but they will repay each other with endless gratitude. In the process of concluding relevant international conventions, we should dare to compete for the right to speak and implement the benefit-sharing system to prevent the unnecessary loss of the "source" of culture.
on the basis of "solid source" of traditional culture, it is necessary to carry out reasonable "diversion". Different from "solid source", "diversion" focuses on the development and utilization of traditional culture. Governments at all levels should take the implementation of the Outline of National Intellectual Property Strategy as an opportunity to formulate and implement intellectual property strategies in their own regions and promote the strategy of revitalizing traditional culture. We should adopt positive cultural policies, fiscal policies and industrial policies, encourage independent cultural innovation, form strong intellectual property rights, realize the industrialization of national culture, and finally change the "east" and "west" directions of knowledge products.
