Whether the dealer will infringe on trademark rights

Hello, poster

If you are a dealer and the goods you represent infringe someone else’s trademark rights, then you are also infringing the trademark rights, specifically according to Article 52 of the Trademark Law Paragraph 2 of Article 52 stipulates that any of the following acts shall constitute infringement of the exclusive right to use a registered trademark:

(1) Without the permission of the trademark registrant , using a trademark that is identical or similar to its registered trademark on the same kind of goods or similar goods;

(2) Selling goods that infringe the exclusive right of a registered trademark;

(3) Counterfeiting or manufacturing other people’s registered trademarks without authorization or selling counterfeit or unauthorized registered trademarks;

(4) Replacing the registered trademark without the consent of the trademark registrant and putting the replaced trademarked goods back into the market market;

(5) Causing other damage to others’ exclusive rights to registered trademarks.

Hope it can help you
