What are the steps and what is the main process when applying for an Italian trademark?

Submit an application

Application materials (need to be in Italian) include the trademark and its display, designated goods or service categories (Italy adopts the Nice Classification), rights holder information, and Italian document service address, priority documents (if any), etc. Trademarks can be applied for online or by submitting application materials to UBIM or to any Italian Chamber of Commerce. Applicants who do not have a business office or residence in Italy should entrust an agent to carry out the application process.

Substantive examination

Examine whether the trademark is registrable in accordance with the law, whether it is identical or similar to a trademark not previously registered, and whether there are prohibited provisions that violate the trademark law. For trademarks that fail to pass substantive examination, the examiner will notify the applicant in writing and inform the applicant of the reasons for rejection. The applicant may submit a review within the time limit from the date of receipt of the rejection notice. Otherwise, the application will be deemed abandoned, and the application date and application number will not be retained.

Announcement

After the examiner considers that the trademark application is acceptable, an announcement will be published on the Italian official trademark announcement. The objection period is 3 months from the date of announcement. Anyone can Opposition can be filed against this trademark.

Registration Approval

Trademarks that are determined to be registrable after opposition, or trademarks that are announced as having no objections will be approved for registration and a registration certificate will be issued
