Sounds can be registered as trademarks~
A sound trademark refers to a trademark consisting of a sound that can distinguish the source of goods or services. The United States, Australia, India and the European Union have all recognized sound trademarks in trademark law and law.
According to Article 8 of the Trademark Law:
“Any sign that can distinguish the goods of a natural person, legal person or other organization from the goods of others, including words, graphics, Letters, numbers, three-dimensional logos, color combinations and sounds, as well as combinations of the above elements, can be applied for registration as trademarks. ”
To register a sound as a trademark, the following important conditions must be met:
1. Special sounds are not allowed to be registered. For example, sounds that are the same as or similar to the melody of the national anthem, military songs, etc. shall not be registered as trademarks. At the same time, the sounds shall not contain ethnic discrimination or other words.
2. Do not damage the prior rights of others.
3. Universal and functional sounds are not allowed to be registered. For example, "Wedding March" cannot be registered as a sound trademark in the wedding service industry.
4. Must be significant. On May 4, 2014, Tencent applied to register the QQ message prompt tone "Didi Didi Didi Didi" as a trademark, but was rejected by the Trademark Office as "the applied trademark consists of simple, ordinary tones or melodies, and cannot be used in designated uses". The application was rejected on the grounds of lack of distinctiveness. Subsequently, Tencent applied for reexamination to the Trademark Review and Adjudication Board and submitted relevant supporting materials. However, the Trademark Review and Adjudication Board rejected the registration application on the grounds that it was "difficult to distinguish the source of services."
