The trademark dispute in Xinghua Village

In October 2010, the nine-year dispute over the trademark rights of "Xinghua Village" between Anhui Xinghua Village Cultural Tourism Development Co., Ltd. and Shanxi Xinghua Village Fen Distillery Co., Ltd. was settled. The tourism service trademark finally landed in Chizhou, Anhui.

In 1999, Zhan Xiaorong, a Chinese living in Europe, came to Chizhou and started the "Xinghua Village" reconstruction project with the approval of the Chizhou Municipal Government. On May 28, 2001, the company applied to register the "Xinghua Village" tourism service registered trademark. On May 28, 2001, Anhui Xinghua Village Cultural Tourism Development Co., Ltd. applied to the Trademark Office of the State Administration for Industry and Commerce to register the "Xinghua Village" tourism service trademark, but was disputed by Shanxi Xinghua Village Fen Distillery Co., Ltd. Since 2001, the two parties have repeatedly gone to court over the ownership of the "Xinghua Village" tourism service trademark. The National Trademark Office, the Trademark Committee of the State Administration for Industry and Commerce, and the Beijing People's Court successively accepted the case and made rulings and judgments respectively that Anhui Xinghua Village Tourism Company had the right to use the trademark. In August 2010, Shanxi Xinghuacun Fen Distillery Co., Ltd. filed an appeal with the Beijing Higher People's Court. On October 8, the Beijing High Court held a public hearing on the case and made a final judgment on October 15, 2010, holding that Shanxi Xinghuacun Company's appeal lacked factual and legal basis and was not supported. The appeal was dismissed and the original judgment was upheld. So far, the "Xinghua Village" tourism service trademark has finally landed in Chizhou, Anhui.
