Article 2 The receiving and consuming departments, production, operation, storage and transportation departments of Xiamen’s imported and exported goods, as well as inspection agencies designated by the Commodity Inspection Bureau, etc., shall accept the supervision and inspection of the Commodity Inspection Bureau. All relevant parties must closely cooperate with the commodity inspection work. Article 3 The Inspection and Quarantine Bureau shall review the imported and exported commodities listed in the "List of Commodity Types Inspected by Commodity Inspection Agencies" (hereinafter referred to as the "Type List"); the commodities that are certified by the Commodity Inspection Bureau as stipulated in the foreign trade contract; and the commodities that are subject to health inspection and quarantine. Compulsory inspections are implemented for exports of food and animal products; cabins, containers, and dangerous goods packaging identification for shipments of grain, oil, food, and frozen products for export. Article 4 For imported commodities included in the "Type List" and imported commodities that are stipulated in the foreign trade contract to be inspected and certified by the Commodity Inspection Bureau, after the goods arrive at the port, the receiving and consuming departments should immediately submit an inspection. The applicant must provide complete relevant documents and information and fill in the imported commodity inspection form. After the Commodity Inspection Bureau stamps a release stamp on the imported goods declaration form, the customs will release it accordingly.
For imported goods that are not included in the "Type List", the receiving and consuming departments shall, after reporting to the Commodity Inspection Bureau, conduct self-inspections in strict accordance with the contract or relevant standards, and submit the inspection results to the Commodity Inspection Bureau within the validity period of the claim. Review sales cases. Otherwise, they will be punished according to Paragraph 2 of Article 39 of the "Implementing Rules". If the self-inspection fails and it is necessary to file a claim externally, it must be submitted to the Commodity Inspection Bureau for re-inspection twenty days before the end of the claim period, and a claim certificate will be issued externally. For imported goods that have been inspected and certified by the Commodity Inspection Bureau and are subject to external claims, the business department, receiving and consuming departments should handle the external claims in a timely manner and submit the results of the claims to the Commodity Inspection Bureau. Article 5 If damaged imported goods are found at Xiamen ports (ports, stations, airports, etc.), the receiving and using departments or shipping agents must promptly apply for damage appraisal to the Commodity Inspection Bureau and provide a damage note signed by the carrier. or business records; the damaged parts should be unloaded and stored separately. Article 6 For complete sets of equipment imported from Xiamen, the receiving and consuming departments should report the arrival status to the Commodity Inspection Bureau in a timely manner, and at the same time conduct inspections in accordance with relevant regulations. The Commodity Inspection Bureau of key imported complete sets of equipment will send personnel to the factory for supervision and inspection. For those that have not been inspected or failed to pass the inspection, the Commodity Inspection Bureau will issue a "Notice of No Installation and Use" as appropriate. Only after the notification is revoked can it be installed and used. Article 7 Units that import motor vehicles shall go through registration inspection with the Commodity Inspection Bureau in a timely manner. The user unit or individual applies for a license from the Public Security Traffic Vehicle Supervision Department with the inspection certificate issued by the Commodity Inspection Bureau, and provides an inspection report to the Commodity Inspection Bureau one month before the expiration of the quality assurance period. Article 8 For export commodities included in the "Type List" and foreign trade contracts that require inspection and certification by the Commodity Inspection Bureau, export foods and animal products that are subject to health inspection and quarantine, the operating department shall prepare the goods seven days before shipment. (Commodities with a long inspection period will be determined separately). Provide relevant information such as the contract, letter of credit, factory inspection form, inspection basis, etc. to the Commodity Inspection Bureau for inspection. The customs will inspect and release the goods based on the inspection certificate or release stamp issued by the Commodity Inspection Bureau. Article 9 Factories and mining enterprises in Xiamen that produce export commodities should register with the Commodity Inspection Bureau. The Commercial and Sewerage Bureau will dispatch personnel to the factory for inspection, factory inspection, random inspection and re-inspection, and sampling inspection as appropriate. When necessary, inspections will be conducted jointly with the competent authorities. A quality license system is implemented for important export commodities, and the Commodity Inspection Bureau reviews it every two years. Enterprises that do not pay attention to product quality are ordered to improve. If the circumstances are serious and the export product quality requirements are still not met within the time limit, the registration will be revoked or the quality license will be revoked, and the products will not be exported. Article 10 Factories and warehouses that produce food for export in Xiamen must apply for registration with the Commodity Inspection Bureau in accordance with the "Measures for the Hygiene Management of Exported Food of the People's Republic of China (Trial)". "Hygienic Requirements", only after obtaining the registration certificate and approval number can the production or storage of export food be allowed. Goods from food factories and warehouses without registration numbers are not allowed to be exported. Article 11 For cabins and containers carrying perishable and volatile food such as grain, oil, food and frozen products for export, the carrier, consignor and packing department or their agent should report to the Commodity Inspection Bureau for inspection two days in advance. A certificate will be issued if the goods are inspected and meet the technical conditions for shipment.
The consignor and carrier shall not ship the goods without obtaining the inspection certificate from the Commodity Inspection Bureau. Article 12 The inspection, supervision and management of imported and exported commodities by wholly foreign-owned enterprises, Sino-foreign joint ventures, and cooperative enterprises in the Xiamen Special Economic Zone shall be handled in accordance with the following regulations:
(1) "Type List" for imports by wholly foreign-owned enterprises "For commodities within the scope, Sino-foreign joint ventures and cooperative enterprises that purchase imported raw and auxiliary materials from foreign third parties are exempted from statutory inspection and can apply for notarization and appraisal.
(2) The goods in the "Type List" produced and exported by wholly foreign-owned enterprises, Sino-foreign joint ventures, and cooperative enterprises are not marked "Made in the People's Republic of China" or use Chinese registered trademarks , can be exempted from statutory inspection and undergo notarization and appraisal upon application. For export commodities involving health and safety, the Commodity Inspection Bureau still implements inspection and supervision management.
(3) If the products of wholly foreign-owned enterprises, Sino-foreign joint ventures, or cooperative enterprises are exported from special economic zones to other regions in the country for sale, they will be regarded as imported goods and shall be subject to inspection supervision and management in accordance with relevant regulations.
(4) Export commodities produced and manufactured by wholly foreign-owned enterprises, Sino-foreign joint ventures, and cooperative enterprises that comply with Chinese government regulations and the standards of preferential countries can apply for the issuance of a certificate of origin under the Generalized System of Preferences for export commodities.
(5) Imported goods by wholly foreign-owned enterprises, Sino-foreign joint ventures, and cooperative enterprises outside the Xiamen Special Economic Zone may refer to the provisions of this article.
