What are the regulations for the issuance and use of trademark agent qualification certificates?

In accordance with the provisions of Article 4 of the "Interim Measures for the Management of Trademark Agency Organizations" and the requirements for trademark agency work, the following provisions are made regarding the issuance and use of the "Trademark Agent Qualification Certificate" (hereinafter referred to as the Qualification Certificate) :

1. Scope of issuance: Trademark agents who are engaged in trademark agency business within a trademark agency organization and have passed the assessment of the Trademark Office.

2. Scope of application: Trademark agents should present their qualification certificates when engaging in trademark agency business.

3. Producing and issuing authority: Qualification certificates are uniformly produced and issued by the Trademark Office of the State Administration for Industry and Commerce.

4. Disciplines that the certificate holder should abide by:

(1) The agent should be carried out in accordance with legal procedures.

(2) No charges may be collected without permission.

(3) The qualification certificate shall not be lent to others.

(4) Evidence shall not be used for personal gain or malpractice for personal gain.

(5) Be civilized, polite, honest and fair.

5. Management of Qualification Certificates:

(1) Trademark agency organizations should register and file the qualification certificates of agents within the organization and formulate unified management measures.

(2) The certificate holder should properly keep the qualification certificate. If it is damaged or lost, he should promptly apply to the issuing authority for a reissue.

(3) The qualification certificate should be registered with the Trademark Office once a year. Unregistered qualification certificates are deemed invalid.

(4) If a trademark agent changes the trademark agency organization, he shall send the qualification certificate to the Trademark Office within one month, and the Trademark Office will affix it and return it.

(5) For trademark agents who violate disciplines, in addition to confiscating their qualification certificates, they should also be given disciplinary sanctions depending on the circumstances.

(6) For those who are transferred out of the trademark agency organization and no longer engage in trademark agency work, the qualification certificate shall be withdrawn by the trademark agency organization and returned to the Trademark Office when they are transferred out of the trademark agency organization.

(7) Trademark agency organizations should report the issuance, loss, and addition of qualification certificates to the Trademark Office at the end of each year.

(8) The Trademark Office will from time to time supervise and inspect the management of qualification certificates of each trademark agency organization and the compliance of certificate holders with discipline.
