1.2 these rules are clauses that increase the basic obligations or restrict the basic rights of users of an acre of land, and all users of an acre of land are equal in the application of the rules.
1.3 the identification and handling of users' violations shall be based on the facts identified in an acre of land and implemented according to the regulations.
1.4 these rules are an inseparable part of the user agreement, the service agreement for suppliers of one acre field, the service agreement for buyers of one acre field, and the rules for reporting and complaining about online transactions of one acre field, and have the same legal effect.
2. Violations and classification
2.1 Class I violations include the following acts:
2.1.1 Publishing goods or information prohibited by the state and other information prohibited by laws, regulations and administrative rules
2.1.2 Selling fake (goods) and selling counterfeit and pirated goods by merchants.
2.1.3 divulging other people's information, including user's behavior of publishing, disclosing and spreading other people's personal information without permission, such as bank card, name, mobile phone number, address and other transaction information.
2.1.4 improper profit-making, including users' behaviors of obtaining benefits by improper means or other means, such as obtaining subsidies/concessions/flow/ranking/grade/transaction amount of an acre field platform by any improper means.
2.1.5 Harassment/abuse (of merchants) refers to the behavior (including platform and operation) that merchants slander, harass, track down, vilify, abuse others or use any words that cause others' dissatisfaction.
2.1.6 disturbing the order of the platform (merchants) refers to the behavior that merchants deliberately evade the rules of the platform through improper means, or obtain and use official resources in an improper way.
2.2 Class II violations include the following behaviors:
2.2.1 Failing to deliver the goods after offline payment, failing to deliver the goods according to the agreement of both parties after offline payment, failing to deliver the goods or failing to contact the supplier in any form (including but not limited to the buyer's failure to get substantive communication with the supplier through chatting on an acre of land and transferring telephone calls), and not returning the received money.
2.2.2 Failure to deliver the goods as agreed refers to the behavior that the description or agreement of the supplier on the product variety, specification, weight, quality, quantity, delivery conditions and other information is inconsistent with the actual transaction performance.
2.2.3 "force buying and force selling" refers to the behavior that the buyer has no intention to buy after seeing the goods on the spot, and the supplier forces the buyer to ask for additional miscellaneous fees (including but not limited to labor costs, miscellaneous fees, handling fees, agency fees, etc., which are not agreed before the buyer sees the goods) and forces the transaction.
2.2.4 failure to pay the payment for goods or miscellaneous fees as agreed refers to the failure of the buyer to pay all or part of the payment for goods or miscellaneous fees as agreed after receiving the goods, such as packaging fees, freight charges, agency fees, labor costs, etc.
2.2.5 failure to return the goods as agreed refers to the behavior that the supplier and the buyer agree to return the goods for a refund after the supplier has refunded, and the buyer fails to return the goods to the supplier as agreed.
2.2.6 false prices (commodities), using false or misleading price means to trick consumers or other business operators into trading with them.
2.2.7 Inconsistency of commodity information (commodity) refers to the inconsistency and mismatch of commodity information elements such as category (category), brand, price, etc. in the commodity information released by merchants in the commodity release interface.
2.2.8 false evaluation refers to the behavior that the supplier obtains untrue evaluation from other users of the platform through improper means.
2.2.9 malicious complaint refers to the behavior that users report or complain to other users in violation of objective facts by fabricating or fabricating facts, maliciously attacking and slandering other users of the platform.
2.3. false propaganda (commodities), in areas such as commodities or shops, the published information of commodities or shops is inconsistent with the actual situation.
2.3.1 stealing pictures (commodities), using other people's trademarks (including word mark and graphic trademarks) or works (written works and graphic works) in commodity information and store names without the permission of others.
2.3.2 publish illegal advertising information (commodities), which are commodities with unknown descriptions and no actual commodities, and only provide the contact information of publishers and non-commodity information.
2.3.3 guide unofficial transactions (merchants), and exchange mobile phone numbers, landline numbers or other contact information with users online in order to conduct transactions through non-official channels of an acre of land or achieve the purpose of receiving and paying.
2.3.4 Pre-sales indicators are too low (merchants), and after-sales indicators of platform assessment include but are not limited to 3-day chat response rate, 3-day telephone connection rate, etc.
2.3.5 After-sales indicators are too high (merchants), and after-sales indicators of platform assessment include but are not limited to 3-day bill skipping rate, 3-day refund rate, dispute refund number, etc.
3. Handling violations
3.1 If a user commits violations, his violations shall be corrected and he shall be punished accordingly.
3.2 the user is deemed as a "class I violation", and according to these rules, the user's violation behavior will be punished by one mu of farmland, such as warning, business restriction, taking off the goods information, sealing up the account, deducting the deposit, freezing the account, deducting the penalty, demoting the store, closing the store, etc.
3.2.1 For "2.1.4", improper profit-making, including the behavior of users seeking improper benefits in an acre of land by using false transactions or any other improper means. Among them, the commonly used means of false transactions (including but not limited to the following situations):
(1) Self-selling and self-buying: refers to the merchants using their own accounts, registering new accounts by themselves or manipulating other accounts, and pretending to be consumers to buy their own products.
For example, friends, classmates and family members make online purchases with each other; Abnormal mutual purchase by internal personnel of the merchant company; Employees or merchants in the business register multiple waistcoats and trumpet by themselves, and purchase the products released by themselves abnormally.
(2) Third-party cooperation: refers to the cooperation with a third party or the improper conduct of false transactions through agreements with others;
(3) False delivery: including but not limited to using false or reused logistics order numbers; The logistics information does not match the actual receiving information; The logistics time is inconsistent with the order; Empty package delivery, non-delivery, or inconsistent actual weight to conduct false transactions and increase commodity transaction volume;
(4) Others: refers to the false trading or illegal profit-making on the platform by other abnormal trading means.
3.2.2. Large-scale false trading behavior in a short period of time:
This situation refers to the improper behavior of merchants who quickly conduct false trading through false trading behavior with short cycle, high frequency, many means and large quantity, and obtain subsidies/concessions/traffic/ranking/grade/transaction amount from the platform.
3.2.3. Two or more merchants cooperate to complete a false transaction for the service, help and convenience of others:
This includes but is not limited to the following situations:
(1) The merchants publish service information related to the false transaction. For example, merchants publish false transactions or hire others to conduct false transactions in the form of text or voice on the platform.
(2) Two or more merchants conduct false transactions in an organized and regular manner. For example, two or more merchants collect the sales volume of the same seller in successive batches to obtain platform subsidies/concessions/traffic/rankings/grades/transaction amounts.
3.2.4. Arbitrage arbitrage:
This situation refers to the merchants making false transactions by using the services or preferential policies provided by the one-acre field platform. For example, merchants conduct false transactions by applying coupons, various subsidies and other related services and policies. .
3.2.5 Take part in any of the above behaviors (hereinafter referred to as "illegal income") such as obtaining benefits/rewards/subsidies/points from an acre of land:
(1) If the first discovery/illegal income is less than 3 yuan (inclusive), a penalty of 5 times of the illegal income will be imposed;
(2) If it is found for more than 2 times (inclusive)/if the amount of illegal income is more than 3 yuan, a penalty of 1 times of the amount of illegal income will be deducted;
the above-mentioned liquidated damages will be deducted from the security deposit account of the illegal user first. If the illegal user fails to pay the corresponding security deposit in full/refuses to pay it, one acre of land has the right to freeze the balance of its fund account (frozen amount = liquidated damages *2 times).
3.2.6 If you illegally obtain non-cash subsidy benefits such as platform flow/ranking/grade/transaction amount of an acre field through the above-mentioned false transaction slip, the punishment rules are as follows:
3.3 If the user is deemed as a "second-class violation", the user will be punished for the violation behavior of an acre field according to these rules, such measures as warning, deleting evaluation, restricting business, removing goods information from the shelves, and sealing up accounts will be taken.
3.3.1 The initial score of user violation score is 12 points. Deduct the corresponding violation points from the total score for each violation, and the deducted points will be cleared automatically after 365 days from the date of the deduction.
3.3.2 if a user's violation score reaches 12 points in the first 365 days from the date of violation deduction, the account will be immediately closed. After the account is sealed up, the violation points will not be cleared.
3.4 if the user violates these rules, Yimutian Company has the right to immediately suspend or terminate all or part of the commercial rights and interests, and offline related signs. If the user is restricted by the account, and the business service is suspended/terminated, the service period will be calculated as usual and will not be extended (the service fee will not be refunded if the account is restricted, suspended or terminated due to the user's reasons), and the responsibilities and losses arising therefrom will be borne by the user himself.
4. Supplementary Provisions
4.1 These Rules shall come into force as of the date of promulgation.
4.2 if the behavior of users of an acre platform occurred before the effective date of these rules, the rules at that time shall apply. If it occurs after the effective date of these rules, these rules shall apply.
4.3 the one-acre field platform has the right to supplement and/or change the contents of these rules according to the business needs, and make it public on the one-acre field APP without separate notice. Once it is published, it will be deemed that every user of the one-acre field platform has been notified.
4.4 users shall abide by the provisions of national laws, administrative regulations, departmental rules and relevant normative documents, and abide by the platform service agreement and platform rules of one acre field. For any act suspected of violating the provisions of national laws, administrative regulations, departmental rules and relevant normative documents, these rules shall apply if they have been stipulated; If there are no provisions in these rules, an acre of land has the right to handle it as appropriate. However, the handling of users by an acre of land does not exempt users from their legal obligations and legal responsibilities.
4.5 when dealing with the penalty for violation of regulations, an acre of land has the right to conduct surface audit on the materials submitted by users according to the knowledge level standards of ordinary people, and make judgments based on the materials. If an acre of land is damaged due to the wrong judgment of the materials submitted by the user, the acre of land will not bear any responsibility.
