(5) The trademark applied for registration shall not be the same as or similar to the registered trademark that has been revoked or cancelled for less than one year.

An application for the registration of a geographical indication as a collective trademark or certification trademark shall also be accompanied by the approval document of the people's government or the competent department of industry that has jurisdiction over the area marked by the geographical indication.
