Article 4 People's governments at all levels are responsible for the safety of edible agricultural products within their respective administrative regions, and shall incorporate the work of improving the quality and ensuring the safety of edible agricultural products into national economic and social development plans, increasing financial investment, establishing and improving coordination mechanisms, and handling edible agricultural products. Major matters of quality and safety supervision and management. Article 5 The relevant administrative supervision and management departments at the city, county, and district levels shall be specifically responsible for the supervision and management of edible agricultural products in accordance with the following division of responsibilities:

(1) The food safety supervision and management department shall be responsible for the comprehensive supervision and management of the safety of edible agricultural products. Supervise, organize and coordinate, and organize the investigation and handling of major accidents in accordance with the law;

(2) The agricultural administrative department is responsible for the supervision and management of the production of primary edible agricultural products;

(7) The environmental protection administrative department is responsible for the supervision and management of environmental pollution prevention and control in the production, processing and business premises of edible agricultural products;

(8) The entry-exit inspection and quarantine department is responsible for the inspection, quarantine and supervision and management of imported and exported edible agricultural products. ;

(9) The urban management law enforcement department is responsible for city appearance supervision, and investigates and punishes illegally constructed edible agricultural product production, processing, and business premises in accordance with the law.

Relevant departments such as development and reform, finance, planning, land, transportation, and public security shall do a good job in the safety of edible agricultural products according to their respective responsibilities. Article 6: Encourage edible agricultural product producers, processors, and operators to establish or join industry associations.

The Edible Agricultural Products Industry Association should play the role of industry self-discipline, assist government departments in the supervision and management of the production, processing, and business activities of edible agricultural products, and establish and improve the internal monitoring and management mechanism for the production, processing, and business activities of edible agricultural products. Provide information and technical guidance and services to members, and urge members to engage in the production, processing and operation of edible agricultural products in accordance with the law. Article 7: Encourage and support the establishment of intermediary service agencies to provide management consulting, technical services, product testing, standardization guidance and other services for the production, processing and operation of edible agricultural products. Article 8 Any unit or individual has the right to report illegal production, processing, and operation of edible agricultural products to the food safety supervision and management department or other administrative supervision and management departments. After receiving a report, the relevant administrative supervision and management department shall investigate and deal with it in accordance with the law if it falls within the scope of its responsibilities; if it does not fall within the scope of its responsibilities, it shall promptly transfer it to the relevant department and inform the whistleblower. If the report is verified to be true, it shall be rewarded in accordance with relevant regulations. Chapter 2 Production and Processing Supervision and Management Article 9 Edible agricultural product production sites shall comply with national and local environmental quality standards.

It is prohibited to produce edible agricultural products in areas where heavy metals, antibiotic residues, pesticide residues and other toxic and harmful substances exceed standards.

People's governments at all levels should formulate ecological agriculture development plans and promote the construction of pollution-free agricultural products, green food, and organic food production bases (hereinafter referred to as production bases).

Article 10 Producers of edible agricultural products shall organize production in accordance with production technical regulations and standards, and use pesticides, veterinary drugs, feed and feed additives, fertilizers and other agricultural inputs (hereinafter referred to as agricultural inputs) in accordance with regulations.

The harvesting of edible agricultural products such as vegetables, fruits, tea, etc. must comply with the prescribed safety interval; the selling or fishing of edible agricultural products such as livestock, poultry, and aquatic products must comply with the prescribed drug withdrawal period.

Encourage the use of production materials such as organic fertilizers, microbial fertilizers, biopesticides and easily degradable films. Article 11 The production base shall establish a quality and safety management system for edible agricultural products, establish and improve quality and safety record files, truthfully record the use time and amount of agricultural inputs, as well as production conditions such as epidemic prevention, quarantine and harmless treatment, and ensure the traceability of products. safety, and make commitments to relevant administrative supervision and management departments and operators regarding the quality and safety of their products.

Other production sites shall be subject to the provisions of the preceding paragraph. Article 12 The production base shall establish a quality and safety inspection system for edible agricultural products, conduct quality and safety inspections on the edible agricultural products produced, and provide product quality certificates. Article 13 During the production process of edible agricultural products, the following behaviors are prohibited:

(1) Using agricultural inputs that have not been approved by the state or province;

(2) Using insecticides , clenbuterol hydrochloride (commonly known as clenbuterol), malachite green and other agricultural inputs that are banned or eliminated by countries and provinces;

(3) Use of methamidophos, parathion (1605), Methyl parathion, malathion, monocrotophos, phorate (3911), omethoate, carbofuran (carbofuran), dicofol and other highly toxic and highly toxic pesticides and their mixtures;

(4) Other behaviors prescribed by laws and regulations.

The sale of agricultural inputs specified in the preceding paragraph is prohibited.
