the label identification of cosmetics mentioned in this specification refers to the words, numbers, symbols, patterns, audio-visual and other materials pasted, connected or printed on the sales packaging of cosmetics, and placed in the sales packaging. The foreign language content not covered in the label shall conform to the provisions of this specification.
article 3 the contents of cosmetic labels must be true, scientific and complete. Cosmetic enterprises should completely mark the relevant contents in accordance with the requirements of the General Label for Cosmetics with Instructions for Use of Consumer Goods (GB5296.3), and be responsible for the authenticity, scientificity and completeness of the label contents.
article 4 the method of use, the location of use, the purpose of use and the efficacy of cosmetics labels shall conform to the definition of cosmetics. Cosmetics must not be effectively publicized, such as "xx cases are effective" and "xx% effective".
Article 5 Cosmetic labels shall clearly and completely identify the relevant license number and approval number. For example, imported cosmetics for special purposes shall be marked with "Wei Zhuang Jin Zi (xxxx)No. xxxx" or "Wei Zhuang Te Jin Zi (xxxx)No. xxxx"; Imported cosmetics for non-special purposes shall be marked with "Wei Zhuang Jin Zi (xxxx)No. xxxx" or "Wei Zhuang Bei Jin Zi (xxxx)No. xxxx"; Domestic cosmetics for special purposes shall be marked with "Wei Zhuang Zi (xxxx)No. xxxx" and the hygiene license number of the cosmetics manufacturing enterprise (such as "<: xx> No xx-XK-xxxx "); Domestic cosmetics for non-special purposes shall be marked with the hygiene license number of the cosmetics manufacturer (such as "<: xx> Wei Zhuang Zhun Zi xx-XK-xxxx ").
products that do not belong to the definition of cosmetics shall not be marked with the hygiene license number of the cosmetics manufacturer.
article 6 the contents of cosmetic label identification, such as product name, manufacturer's name, name and address of the responsible unit (importer or seller) in China, country of origin (actual production country), actual domestic production place, color, color number, fragrance, sun protection coefficient, function and other information, shall be consistent with the relevant contents stated in the product's approval document, filing certificate and hygiene license of the manufacturer, and shall be consistent with the approval.
article 7 labeling requirements for cosmetic names
(1) cosmetic names shall conform to the requirements of the regulations on naming health-related products, and in principle, names shall include brand names, generic names and attribute names.
(2) The name shall be clearly marked, complete and easy to identify, and the marking methods that are likely to confuse, mislead consumers or have other adverse effects shall not be used. There should be at least one complete name in the label, that is, except the trademark, the words or symbols in the name should use the same font and font size, and there should be no gaps.
(3) trademarks with exaggerated functions or misleading consumers shall not be used in the name.
(4) Generic names shall be accurate and scientific, and may be words indicating raw materials, main functional components or product functions. When raw materials or functional ingredients are used as generic names, they must be the raw materials and ingredients contained in the product formula, except for words that are only understood as the color, luster or smell of the product, such as pearl color, fruit type and rose type. When a function is used as a generic name, it must be the real function of the product.
(5) Attribute names should indicate the objective form of products, and abstract names are not allowed. However, for products whose attributes are known to consumers, the attribute names can be omitted, such as lipstick, rouge, lip gloss, face gloss, cheek gloss, hair gloss, eye gloss, eye shadow, conditioner, essence, mask, hair mask, blush and nail polish.
(6) if the same brand name, common name and attribute name are used for the same series of cosmetics, but the fragrance and color are different, they must be marked after the product name to show the difference. The name of hair dyeing products must be marked with the dyed color or color number.
article 8 labeling of sunscreen cosmetics
(1) all cosmetics that claim to have sunscreen function must be labeled with SPF value; It can identify UVA protection function, broad-spectrum sun protection function, PFA value or PA+~ PA++,waterproof and sweat-proof function or suitable for outdoor activities such as swimming. All the sun protection functions of the logo must provide effective inspection basis.
(2) The identification of SPF value of sunscreen cosmetics shall meet the following requirements:
1. When the SPF value of the tested product is less than 2, the sunscreen effect shall not be identified.
2. when the SPF value of the tested product is between 2 and 3 (inclusive), the identification value shall not be higher than the measured value.
3. when the SPF value of the tested product is greater than 3 and less than or equal to 3 after subtracting the standard deviation, only SPF3 can be identified at most.
4. when the SPF value of the tested product is higher than 3 and still higher than 3 after subtracting the standard deviation, only SPF3+ can be identified at most.
(3) The identification of the PFA value of sunscreen cosmetics shall meet the following requirements:
1. When the integer part of the measured PFA value of the tested product is less than 2, the sunscreen effect of UVA shall not be identified.
2. when the integer part of the measured PFA value of the tested product is between 2 and 3 (inclusive), the integer part of PA+ or PFA measured value can be identified.
3. when the integer part of the measured PFA value of the tested product is between 4 and 7 (inclusive), the integer part of PA++ or PFA measured value can be identified.
4. when the integer part of the measured PFA value of the tested product is greater than or equal to 8, the integer part of PA++ or PFA measured value can be identified.
(4) sunscreen cosmetics that meet one of the following requirements can be marked with broad-spectrum sunscreen:
1. SPF value ≥2, and lC≥37nm as determined by cosmetics anti-UVA instrument.
2. SPF value ≥2 and PFA value ≥2.
(5) When identifying the waterproof performance, sunscreen cosmetics should identify the SPF value after bathing, and can also identify the SPF value before and after bathing. And mark the waterproof degree strictly according to the waterproof test results:
1. If the SPF value after bathing is reduced by more than 5% compared with that before bathing, the waterproof performance shall not be claimed.
2. those who pass the 4-minute water resistance test can claim general water resistance (such as waterproof and sweat-proof functions, suitable for outdoor activities such as swimming, etc.), and the claimed water resistance time shall not exceed 4 minutes.
3. those who pass the 8-minute water resistance test can be claimed to have superior water resistance, and the claimed water resistance time does not exceed 8 minutes.
article 9 if the labels of cosmetics are marked with related terms such as "tested by dermatologists or ophthalmologists", "tested by allergy", "suitable for sensitive skin" and "free from acne", relevant test data and/or clinical reports must be taken as the basis.
Article 1 Labeling of information about cosmetics products that are commissioned for processing (including sub-packaging)
(1) If the cosmetics are commissioned for production and processing, the name and address of the entrusting party, as well as the name and hygiene license number of the entrusted party must be marked.
(2) if the product owner is different from the actual production and processing enterprise, if the product owner is the head office and the actual production and processing enterprise is a subordinate enterprise, it shall be marked with reference to the above provisions.
Article 11 Labeling of warning words
(1) Cosmetic labels should be marked with necessary warning information, such as conditions of use, methods of use, precautions, possible adverse reactions, etc. Encourage cosmetics labels to mark "This product has allergic reaction to a few people, please stop using it immediately if you feel uncomfortable".
(2) The scope of use and methods of use marked on the cosmetics label shall meet the safety requirements of the raw materials contained therein. For example, some raw materials can only be used in products that are rinsed off after use or cannot touch mucous membranes during use, so the labeling contents of cosmetics containing these raw materials should meet these use restrictions.
(3) If cosmetics contain restricted substances, preservatives, ultraviolet absorbers, hair dyes, etc. specified in the current Hygienic Standard for Cosmetics, the corresponding use conditions and precautions should be marked on the label according to the requirements of the Hygienic Standard for Cosmetics.
(4) The labels of hair care products, hair dyeing products, perming products, deodorizing products, hair removal products and nail hardeners must be marked with the conditions of use, methods of use and precautions. Hair dye cosmetics (except temporary hair dye products) must be marked with the following warning words on the label: for some individuals who may cause allergic reactions, skin tests should be carried out in advance according to the instructions; Do not use it to dye eyebrows and eyelashes. If it accidentally enters the eyes, it should be washed immediately. When using professionally, you should wear appropriate gloves and other related terms.
(5) Hair care, breast care and bodybuilding products must be marked on the label: the efficacy of this product has not been verified by the inspection agency of the Ministry of Health.
(6) The following types of cosmetics should be marked with corresponding warnings on the labels:
1. Pressure-filled aerosol products: the products must not collide; Use away from fire sources; The storage environment of the product should be dry and ventilated, and the temperature should be below 5℃. It should avoid direct sunlight and stay away from fire sources and heat sources. Products should be kept out of reach of children; Empty cans used up by products should not be pierced and thrown into the fire; Keep a distance from the skin when spraying, avoid the mouth, nose and eyes, and do not use it when the skin is damaged, inflamed or itchy.
2. Foam bath products: use according to the instructions; Excessive use or long-term contact can cause irritation to skin and urethra; Stop using when rash, redness or itching occurs; Keep it out of the reach of children.
article 12 the functions promoted by cosmetics must be true and scientific, and conform to the functional categories stipulated in the definition of cosmetics, namely, cleaning, eliminating bad smell, caring skin, beautifying, modifying and special-purpose functions. It is not allowed to imply that the product does not actually have or is not allowed to promote the function by promoting the function of the raw materials used. Ordinary cosmetics shall not publicize the functions of special-purpose cosmetics.
Article 13 According to the Regulations on Hygienic Supervision of Cosmetics and other relevant regulations and standards, the labeling contents of cosmetics shall be true, and there shall be no contents that falsely exaggerate, express or imply the therapeutic effect and effect on diseases, no medical terms shall be used, no consumers shall be misled, no products shall be publicized in the name of "approved by the Ministry of Health" or "specially approved by the Ministry of Health", and no cosmetics shall be approved or approved.
Annex 1 and Annex 2 of Article 14 respectively list the terms for declaring the recommended function of cosmetic labels and the terms for prohibiting labeling, but they are not limited to the listed contents, and the Ministry of Health will supplement them irregularly.
article 15 if the previously published documents are inconsistent with this specification, this specification shall prevail. The Ministry of Health is responsible for the interpretation of this specification.
