Second, priority.

The two sides agreed to confirm the effectiveness of the first application date of the patent, trademark and variety right of the other side according to their respective regulations, and actively promote corresponding arrangements to protect the priority rights and interests of people on both sides of the strait.

The Agreement on Cross-Strait Cooperation in Intellectual Property Protection was signed by Jiang Yu/KLOC-0 on June 29th, 1999, and took effect on September 6th of the same year. When both parties begin to accept each other's patent, trademark and plant variety priority claims is a topic of concern from all walks of life. Since the entry into force of the agreement, the competent authorities on both sides of the strait have made efforts to complete the adjustment of internal related operations, and both sides have decided to accept basic cases from this year1October 22nd 165438+, and the date for claiming priority is this year12nd (that is, the effective date of the agreement).

Since the mutual recognition of patents, trademarks and plant variety rights across the Taiwan Strait involves the adjustment of related businesses in China and Chinese mainland, the two sides have conducted many communications, consultations and a lot of preparations. With the utmost goodwill, Chinese mainland actively and quickly cooperated to make relevant adjustments and amendments, including amending the relevant provisions on accepting applications from Taiwan Province Province, so that mutual acceptance can be announced more than two months after the agreement came into effect.

In addition, regarding the process of appointing relevant associations or organizations in Taiwan Province Province to handle the copyright certification of audio-visual products in Taiwan Province Province, Chinese mainland said that once the relevant procedures are completed, Taiwan Province Copyright Protection Association can start the relevant certification operation.

In order to make people understand the implementation effect and related details of the "cross-strait intellectual property protection cooperation" agreement, the Intelligence Bureau of the Ministry of Economic Affairs will release relevant instructions in the near future.
