What are the main registration procedures for Dutch trademarks?

Dutch Trademark Registration

Trademark registration agency: Benelux Trademark Office.

Trademark validity:

The validity period is 10 years.

Registration can be renewed indefinitely, and each renewal registration is still valid for 10 years.

A successfully registered trademark will be valid in the Netherlands, Belgium and Luxembourg.

Applicant qualifications:

Benelux follows the principle of first-to-file trademark registration.

Only the prior trademark applicant has the right to obtain trademark registration and exclusive use of the trademark.

Natural persons or legal persons can apply for trademark registration.

The actual user of a trademark must sign a trademark license contract and file it with the Benelux Trademark Registration Office.

Instructions for trademark registration information:

To apply as a legal person, provide a copy of the business license or valid registration certificate with the official seal;

To apply as a natural person, provide proof of identity Documents;

Applicant’s detailed information in Chinese and English, including: name, nature, nationality, detailed address, postal code, contact information, etc.;

Electronic clear trademark sample ;

Product name and category.

Trademark registration process:

1. Submit the application.

Download the Dutch or French application form 6991 from the Benelux Trademark Office website 156 and submit it by letter, fax or door-to-door submission 3780, or apply online.

The Benelux Trademark Office will send a letter to inform you whether the application meets the minimum standards and the registration fee payable.

Applicants should pay the registration fee for ordinary trademarks within 1 month after submitting the application.

The Benelux Trademark Office’s processing time for trademark applications is 10-15 working days

2. Publication application.

The Benelux Trademark Office publishes application requirements through the registered trademark registration database.

3. Substantive review.

The Benelux Trademark Office generally takes 3 to 4 months to conduct a substantive review of a trademark.

Within 2 months after the announcement, other registered trademark holders have the right to object.

If the negotiation fails, the Benelux Trademark Office will make a decision.

After the trademark registration review is passed, the Benelux Trademark Office will issue a trademark registration certificate to the applicant.

If the review fails, the applicant can apply for reconsideration in writing within 6 months.

If the Trademark Office refuses to change the decision, the applicant can appeal to the court.

Under special circumstances, you can request expedited processing, and you need to pay an expedited fee. The trademark registration procedure can be completed within a few days. However, after the trademark registration is successful, a substantive review will still be conducted.
