Can foreign trademark's registration in China be revoked?
No, the spatial scope of the Trademark Law is China (except Hong Kong, Macao and Taiwan). Therefore, to register a trademark in China, we only need to consider the registrability of the existing trademark in China. As long as there is no earlier identical or similar trademark in China, we can be allowed to register. First of all, China has clear provisions on trademark protection. Without the permission of the trademark registrant, the same trademark is used on the same commodity. It is an infringement of the exclusive right to use a registered trademark. A registered trademark contains the common name, figure and model of a commodity, or directly indicates the quality, main raw materials, functions, uses, weight and quantity of a commodity, or contains a place name. The exclusive right to use a registered trademark has no right to prohibit others from using it properly. Summary: Foreign trademarks belong to the category of foreign protection, while domestic registered trademarks, for example, are protected by China's trademark law. Without the permission of the trademark registrant, it is an act of infringing the exclusive right to use a registered trademark to use the same trademark on the same commodity.
