What is the duration of property preservation?
the duration of property preservation is three years.

if the applicant fails to bring a lawsuit or apply for arbitration according to law within 3 days after the people's court takes the preservation measures, the people's court shall lift the preservation. Therefore, the property preservation period is 3 days. The people's court shall not freeze the bank deposits of the person subjected to execution for more than one year, seal up or detain movable property for more than two years, seal up immovable property and freeze other property rights for more than three years.

Objects of property preservation:

1. Accounts and deposits opened by the defendant in the bank;

2. The property registered by the defendant in the real estate trading center with ownership, or the land with the right to use;

3. The defendant's foreign investment in equity, stocks, bonds, dividends, bonuses and other income;

4. The vehicle of which the defendant has ownership;

5. The factory buildings, machinery and equipment, raw materials, semi-finished products, finished products and other goods owned by the defendant;

6. The creditor's rights due to others enjoyed by the defendant and the rent payable to the defendant by others;

7. The defendant enjoys intellectual property rights such as patents and trademarks with exclusive rights;

8. Other kinds of property with monetary value and rights owned by defendants.

to sum up, the effectiveness of property preservation is not indefinite, and generally lasts until the date when the judgment comes into effect and the court applies for enforcement.

Article 486 of the Supreme People's Court's Interpretation of Application

The people's court shall not dispose of the executed property unless it is sealed up, seized or frozen. For all kinds of property that can be directly deducted, such as bank deposits, the deduction ruling of the people's court also has the legal effect of freezing.

Article 487

The time limit for the people's court to freeze the bank deposits of the person subjected to execution shall not exceed one year, the time limit for sealing up or distraining movable property shall not exceed two years, and the time limit for sealing up immovable property and freezing other property rights shall not exceed three years.

if the executor applies for an extension of the time limit, the people's court shall go through the formalities for further sealing up, distraining and freezing before the expiration of the time limit for sealing up, distraining and freezing, and the time limit for further sealing up, distraining and freezing shall not exceed the time limit specified in the preceding paragraph.

the people's court may also handle the formalities of continued sealing up, seizure and freezing ex officio.
