The letters that constitute a trademark refer to the smallest writing unit of pinyin characters or phonetic symbols, including pinyin characters, foreign letters such as English letters, Latin letters, etc. The original Trademark Law classified trademarks consisting only of letters into the category of word trademarks. However, the newly revised Trademark Law in 2001 regarded letters as one of the constituent elements of a trademark. This provision is more realistic and convenient for trademark supervisors. The department reviews and approves trademark registration applications in accordance with the law.
Numbers as components of trademarks are also new provisions of the 2001 new Trademark Law. The numbers constituting the trademark can be either Arabic numerals or Chinese uppercase numerals.
Generally speaking, single letters or numbers cannot be registered in most censorship countries around the world due to their lack of distinctiveness. Therefore, there must be more than two letters or numbers before it can be used as a word mark.
Texts or numbers in different languages ??can be combined with each other. The combination of words can use meaningful words or made-up words without any meaning.
Word marks shall not use words prohibited from use in Articles 10 and 11 of the Trademark Law.
It should be noted that:
① When examining trademarks in my country, except for trademarks composed of Chinese characters (including Chinese pinyin) and English characters, which are directly searched according to the meaning of the words, other words are Graphic elements are classified into categories and then retrieved as graphics.
② In addition to Chinese characters, Chinese pinyin, English and English letters, when applying for a registered trademark, other ethnic minority characters and foreign characters and letters should be accompanied by a description of what kind of characters they are and their corresponding meanings. Therefore, if there are no special needs, Chinese characters (including Chinese pinyin) or English characters should be the first choice for word trademarks.
