Colors in trademarks

a registered trademark is a legal term, which refers to a trademark approved and registered by the relevant government departments. The trademark applicant has the exclusive right to use a brand name and brand logo, which are protected by law and cannot be imitated by any other enterprise. Protected by law, trademark registrants enjoy the exclusive right to use their trademarks.

a registered trademark refers to a brand or a part of a brand that has obtained the exclusive right and is protected by law. A registered trademark is a sign that identifies a commodity or service or a specific individual or enterprise related to it.

a trademark is a distinctive symbol made up of characters, figures, letters, numbers, three-dimensional symbols, sounds and colors, or the combination of the above elements, which is adopted by the producers and operators of commodities on the commodities they produce, manufacture, process, select or distribute or the services provided by service providers, and is used to distinguish the sources of commodities or services. It is a product of modern economy.

So, is it better to register a registered trademark in black or in color? Is it ok to change the registered trademark to another color? However, the answer is what color the registered trademark is and what color it is used, otherwise it is easy for the Trademark Office to revoke the trademark because of the irregular use of the trademark.

I suggest that you can apply for a black and white trademark if you want to change the trademark color. When applying for registration of a color trademark, the same color or color combination as the registration must be used in actual use, while black and white trademarks are regarded as unlimited colors. When applying for registration of a black-and-white trademark, you can use any color in actual use, which is more flexible.

Article 44 Where a registered trademark is used in any of the following acts, the Trademark Office shall order it to correct or cancel its registered trademark within a time limit:

(1) Changing the registered trademark on its own;

(2) changing the name, address or other registered items of the registrant of a registered trademark;

(3) transferring a registered trademark by itself;

(4) it has been stopped for three consecutive years.

The term "self-change" here includes the change of the designated color of a registered trademark. Therefore, in general, how to register a trademark and how to use it after registration cannot be changed at will. Here, the author needs to remind that the use of any changed trademark is regarded as the use of a new unregistered trademark, not as the use of the original registered trademark. The non-standard use has lost direct contact with the original registered trademark, which has a negative impact on the long-term accumulation of the brand and its future identification and fame.

The general profession suggests applying in black and white. Therefore, in the thousands of trademark registration applications represented by the author, most customers apply in black and white. However, there will still be cases of applying for a specified color. Sometimes, it is entirely possible for a customer to design a trademark and make sure that the color will not change, and it is entirely possible to apply for a specified color out of subjective will.
