According to the provisions of Article 38 of the Trademark Law, "if a registered trademark needs to continue to be used after its expiration, it shall apply for renewal of registration within six months before its expiration; Failing to apply within this time limit, a grace period of 6 months may be granted. If no application is made at the expiration of the exhibition period, its registered trademark shall be cancelled. Each renewal of registration is valid for ten years. After the renewal of registration is approved, it will be announced. " In other words, an application for trademark renewal registration can be filed six months before the expiration of the trademark and six months after the expiration of the trademark, and the trademark office will accept it.
Examples are as follows: If the trademark of an enterprise is valid from1985 July 10 to1995 July 9, then it should apply for renewal from1995 June 10 to1995 July 9. It can also be put forward within the grace period stipulated by law, that is, it can also be put forward within1995 July 10 to 1996 1.9. However, even if an application for renewal is filed within the grace period, the validity period after the renewal is approved is still calculated from the date when the original registration expires, not from the date when the grace period expires. Therefore, from the above example, the ten-year renewal is calculated from the day after the expiration of the trademark validity period, not from the date of application for renewal or the date of announcement and approval.
Mode of renewal of registered trademarks
There are two ways to apply for the renewal of a registered trademark:
(1) Entrust a nationally recognized trademark agency to handle it.
(2) The applicant goes directly to the trademark registration hall of the Trademark Office.
