Legal analysis:
Using someone else’s invalid trademark may constitute infringement. After the trademark is invalid, there is still a one-year protection period, that is, only this company can register the trademark within this year. To succeed, nothing else can pass. Therefore, after a general trademark expires, it is protected for one and a half years, and registration by others is not allowed. In other words: 1. A grace period of 6 months after expiration. 2. The original trademark owner can give priority to re-register, and the protection period is 12 months. After the above conditions expire, everyone has the right to register. Legal basis:
Article 24 of the "Regulations on Expropriation and Compensation of Houses on State-Owned Land" stipulates that the people's governments at the municipal and county levels and their relevant departments shall strengthen the supervision and management of construction activities in accordance with the law, and conduct violations of urban and rural regulations. Planning and construction will be handled in accordance with the law. Before making a decision on house expropriation, the municipal and county-level people's governments should organize relevant departments to investigate, identify and deal with unregistered buildings within the expropriation scope in accordance with the law. Compensation shall be given to temporary buildings that are deemed to be legal buildings and have not exceeded the approved period; compensation shall not be provided to illegal buildings and temporary buildings that have exceeded the approved period.
