How to transfer a trademark and where to transfer it?

According to the provisions of my country's Trademark Law, the transferor and transferee of a trademark should sign a transfer agreement and apply for trademark transfer to the Trademark Office at the same time.

Trademark Law of the People's Republic of China

Article 42: When a registered trademark is transferred, the transferor and the transferee shall sign a transfer agreement and sign a transfer agreement in the same direction. File an application with the Trademark Office. The transferee shall ensure the quality of the goods using the registered trademark.

When transferring a registered trademark, the trademark registrant shall transfer its similar trademark registered on the same kind of goods, or the same or similar trademark registered on similar goods.

For transfers that are likely to cause confusion or other adverse effects, the Trademark Office will not approve the transfer and will notify the applicant in writing to explain the reasons.

After the registered trademark is approved, it shall be announced. The assignee shall enjoy the exclusive right to use the trademark from the date of announcement.

Trademark transfer refers to the act of a trademark registrant transferring the exclusive right to use a trademark to another person in accordance with legal procedures during the validity period of the registered trademark. Trademark transfer generally takes the following forms: contractual transfer, continuous transfer, and transfer due to administrative orders.

The following conditions should be met:

1. If a registered trademark is transferred to another person, the transfer procedures must be completed with the Trademark Office.

3. If the exclusive right to use a trademark is transferred based on a court judgment, the transfer procedures must also be completed.

4. When transferring a trademark, you need to transfer the similar trademark on hand. For trademark transfer or transfer, the "Transfer Application Form/Registered Trademark Application Form" should be filled out. Since September 15, 2002, trademarks that have been applied for but have not yet been approved for registration can also apply for transfer or transfer.
