The State Administration for Industry and Commerce is an agency directly under the State Council in charge of market supervision and management and related administrative law enforcement.
Their main responsibilities are:
1. Research and formulate industrial and commercial administration guidelines and policies, organize the drafting of relevant laws and regulations, and formulate and issue industrial and commercial administrative regulations.
2. Organize and manage the registration of various enterprises (including foreign-invested enterprises) and entities and individuals engaged in business activities as well as permanent representative offices of foreign (regional) enterprises in accordance with the law, verify the name of the registered unit, review and approve , issue relevant licenses and implement supervision and management.
3. Organize and supervise market competition in accordance with the law, and investigate and deal with economic violations such as monopoly, unfair competition, smuggling, pyramid schemes and disguised pyramid schemes.
4. Organize and supervise market transactions in accordance with the law, organize and supervise the quality of commodities in the circulation field, organize and investigate and deal with counterfeiting and other illegal activities, and protect the legitimate rights and interests of operators and consumers.
5. Implement standardized management and supervision of various market operations in accordance with the law.
6. Organize and supervise brokers and brokerage institutions in accordance with the law.
7. Organize and implement the administrative supervision of contracts in accordance with the law, organize and manage the registration of chattel mortgages, organize and supervise auctions, and investigate and deal with contract fraud and other illegal activities.
8. Supervise and manage advertising in accordance with the law and investigate and punish illegal activities.
9. Responsible for trademark registration and trademark management, protecting trademark exclusive rights, organizing the investigation and handling of trademark infringements, and strengthening the certification and protection of well-known trademarks.
10. Organize and supervise the business activities of individual industrial and commercial households, individual partnerships and private enterprises in accordance with the law.
11. Lead the national industrial and commercial administration work.
12. Carry out international cooperation and exchanges in industrial and commercial administration.
13. Undertake other matters assigned by the State Council.
