Huawei’s “Hongmeng” trademark application was rejected because a similar trademark already exists

On May 12, the Beijing Court Trial Information Network published the relevant judgments between Huawei Technologies Co., Ltd. (hereinafter referred to as "Huawei") and the State Intellectual Property Office. The judgment shows that Huawei’s lawsuit was rejected by the court.

This incident originated in May 2020, when Huawei’s application for registration of the “Hongmeng” trademark No. 38307327 was rejected by the State Intellectual Property Office , the reason is that it has constituted the situation mentioned in Article 30 of the Trademark Law of the People's Republic of China.

Article 30 refers to “any trademark applied for registration that does not comply with the relevant provisions of this Law or is identical or similar to a trademark that has been registered or preliminarily approved by others on the same or similar goods. , the Trademark Office rejected the application and did not publish it.”

According to the information found by the court, two companies have registered trademark information related to “Hongmeng”, including Beijing Coast Hongmeng Standard Material Technology Co., Ltd. and Hebei Hongmeng Advertising Development Co., Ltd.

In this regard, Huawei gave three reasons and requested the court to revoke the decision of the State Intellectual Property Office and order it to make a new decision.

The Beijing Intellectual Property Court believes that Huawei’s claim to suspend the trial of the case is insufficiently based and will not be supported. At the same time, the State Intellectual Property Office rejected the registration application for legitimate reasons, legal procedures, and correct application of laws and regulations. Huawei's claims lack factual and legal basis and will not be supported.

In the end, the court ruled: Huawei’s lawsuit was rejected, and Huawei should bear the case acceptance fee of 100 yuan.
