1. What is trademark renewal registration? Trademark renewal registration refers to the legal procedure in which the trademark registrant applies to extend the validity period of a registered trademark within the legal period in order not to lose the exclusive right after the expiration of the registered trademark. The object of trademark renewal registration is a registered trademark, and the procedure is relatively simple. As long as you submit a renewal application within the legal period and pay the prescribed fee, you can obtain the renewal registration. 2. The renewal period of trademark renewal registration. The trademark renewal period stipulated in the Trademark Law includes two parts: first, 6 months before the expiration of the registered trademark; second, 6 months after the expiration of the registered trademark, which is the extension period. As long as the trademark registrant submits a renewal application and pays the prescribed fee within the time limit specified by law, the exclusive right to use the registered trademark can be extended. According to the provisions of Article 27 of the "Regulations for the Implementation of the Trademark Law", the validity period of a renewed registered trademark shall be calculated from the day after the expiration of the previous term of validity of the trademark, not from the date of approval of the renewal. It can be seen that trademark renewal registration is to extend the validity period of the trademark exclusive right that has been obtained. If a registered trademark that has submitted an application for renewal during the extension period is not protected, then once the renewal is successful, the exclusive right to use the trademark will not be effectively protected from the expiration of the registered trademark to the announcement of the renewal. According to the provisions of the Trademark Law The validity period of a renewed registered trademark is calculated from the day after the expiration of the previous term of validity of the trademark and it loses its meaning. It can be seen that the original intention of the Trademark Law and its Implementing Regulations is that registered trademarks within the renewal period should be protected. This is also reflected in judicial practice. Article 5 of the "Interpretations of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Civil Trademark Dispute Cases" stipulates: "The trademark registrant or interested party files a renewal application within the extension period for the renewal of a registered trademark. If a lawsuit is filed regarding the exclusive right to use a registered trademark, the People’s Court shall accept it.”
