How does an individual apply for a food trademark?

First of all, registering a trademark is very simple. Let’s first understand the procedures and required materials for registering a trademark:

Trademark registration procedures and fees:

( 1) Materials:

1. A copy of "Application for Trademark Registration". Company applications need to be stamped with the official seal, and individual applications only need to be signed.

2. Applicant certification documents: If a company applies, it is necessary to submit a copy of the "Copy of Business License"; if an individual applies, it is necessary to submit a copy of the ID card and a copy of the individual industrial and commercial household.

3. The "Trademark Agency Power of Attorney" must be stamped with your "official seal" or "signature".

(2) Time:

1. After filing the application, the State Trademark Office will issue the "Notice of Trademark Acceptance" in about one month.

After receiving the "Trademark Registration Acceptance Notice", the trademark can be marked with the TM logo in the upper right corner or lower right corner of the trademark.

2. Within six months after the application is accepted, the Trademark Office will enter the trademark information into the China Trademark Network website. At that time, the trademark information you applied for can be found on the China Trademark Website.

3. About eight months from the date of application, the Trademark Office will conduct a substantive examination of the trademark.

4. Around September when the application was filed, the Trademark Office issued a preliminary review announcement.

5. Three months after the announcement, the "Trademark Registration Certificate" will be issued. After receiving the trademark registration certificate, you can put the registration mark on the upper right corner or lower right corner of the trademark.

6. The total registration time is about 1 year.

Trademark fee: The registration fee is 1,800 yuan each (including official and our agency fees charged by the state). The registration period is ten years. There is no annual fee during the period of use. If the trademark needs to be continued after ten years You can apply for renewal.

Secondly, let’s take a look at the categories in the international classification table where food trademarks are located:

Foods are involved in categories 29, 30 and 31 in the international classification table of similar goods. Category 29 includes meat, fish, processed and pickled vegetables and fruits, jelly, preserves, eggs, milk and dairy products, and edible oils. Category 30 includes coffee, tea, rice, noodles, flour products, pastries, moon cakes, sugar, salt, seasonings and other products. Class 31 is cereals, agricultural products, fresh fruits and vegetables, seeds, animal feed, etc. In addition, Category 32 includes beverages, beer, juice and other products. Category 33 is liquor and other alcoholic beverages.

Before registering your trademark, you need to know which category your product belongs to, and then choose ten products in that category (you can choose ten products for one trademark, and there is an additional fee for more than ten products) ) for registered trademark protection.
