What is a collective trademark? What documents need to be submitted?

Collective Mark refers to a trademark that is jointly owned by several different owners. It is called a collective mark. In some countries, it may also be registered by a federation of enterprises as a representative, and sometimes by the government agency leading these enterprises. The function of a collective trademark is to indicate to users that the companies using the trademark have the same characteristics. An enterprise using a collective trademark has the right to use other exclusive trademarks at the same time. Collective trademarks are generally not transferable. The trademark laws of China, the United States, most Western countries with civil law systems, some Eastern European countries and some developing countries all have provisions for registration protection of collective trademarks.

The application documents that need to be submitted to apply for a collective trademark mainly include:

1. "Application for Trademark Registration". Please refer to the filling instructions for details on filling requirements.

2. Documents and copies of the collective trademark applicant’s subject qualifications, or a valid copy with the applicant’s seal.

3. Management rules for the use of collective trademarks.

4. List of collective members.

5. If you go directly to the trademark registration hall to apply for registration, you must submit the ID card and copy of the person in charge; if you entrust a trademark agency to handle the registration application, you must submit a trademark agency power of attorney.

6. If the collective trademark applied for registration is a portrait of a person, a notarized declaration document from the portrait owner agreeing to register the portrait as a trademark should be attached.
