Application materials and processing procedures

(1) Preparation of application documents

1. The application documents that should be submitted are:

(1) "Application for Trademark Registration Renewal"

(2) A copy of the applicant's subject qualification certificate confirmed by seal or signature

(3) Directly at the Trademark Registration Submit the ID card of the person handling the application in the lobby (the original will be returned after comparison)

(4) If the application documents are in a foreign language, a Chinese translation should also be attached.

2. Specific instructions

(1) Fill in the application form one by one and must be typed or printed. If the applicant is a natural person, the ID number should be filled in after the name.

(2) One application for renewal registration should be submitted for each trademark.

(3) If a trademark agency is entrusted to handle the matter, a trademark agency power of attorney should be submitted.

(4) If the trademark applied for renewal is an owned trademark, the application should be submitted in the name of the representative.

(5) According to the provisions of Article 34 of the "Trademark Law", if the objection is determined to be untenable and the registration of the trademark is approved, the time when the trademark registration applicant obtains the exclusive right to trademark shall be announced after the preliminary examination. Calculated from the expiry date of three months. Therefore, if a trademark that is still in the process of opposition, opposition review, or opposition review proceedings and has reached the trademark renewal period, you can apply for renewal within twelve months before the expiration of the validity period; if you fail to apply during this period, you may be granted Six months grace period. Our office will decide whether to approve the renewal based on the final result of the objection, objection review or litigation. If the trademark is ultimately disapproved for registration, our office will not approve the renewal application and the application fee can be refunded.

(2) Submit application documents

1. If applying directly, submit the application at the acceptance window of the trademark registration hall.

2. If a trademark agency is entrusted to handle the application, the trademark agency will deliver the application documents to the Trademark Office.

(3) Pay the renewal fee

Applications are charged according to category. A category renewal registration application requires a fee of RMB 1,000. If the renewal is submitted during the extension period Those who apply for registration will also need to pay a delay fee of RMB 250.

If a trademark agency is entrusted to handle the matter, the Trademark Office will deduct the fee from the advance payment of the trademark agency.
