The trademark registration process must have the following stages: trademark search, trademark application, formal examination, substantive examination, preliminary examination announcement, and registered trademark certification. 1. Trademark search: Article 28 of China’s Trademark Law stipulates that any trademark applied for registration does not comply with the relevant provisions of this law or is the same as or the same trademark that has been registered or preliminarily approved by others on the same or similar goods. If the application is similar, the Trademark Office will reject the application and will not publish it. Therefore, before submitting a trademark registration application, you must conduct a trademark query to understand whether there are similar or identical trademarks to the trademark you are applying for, thereby reducing blindness and reducing the risk of trademark registration. 2. Trademark application: There are two ways to submit a trademark registration application: one is to go directly to the Trademark Office; the other is to entrust a nationally recognized trademark agency to act as an agent. 3. Formal review: The formal review of trademark registration refers to the review of the application, the review of the specifications, clarity and necessary explanations of the trademark drawing, and the review of the reported goods/services after the trademark application is submitted. After passing the formal examination, an acceptance notice will be issued. 4. Substantive examination: Substantive examination is a series of activities that examine whether a trademark complies with the laws and regulations of the Trademark Law, including data retrieval, analysis and comparison, investigation and research, and decisions to grant preliminary approval or reject the application. 5. Preliminary review announcement: After review by the Trademark Office, a preliminary review announcement will be made for a trademark that complies with the provisions of the Trademark Law. Within three months from the date of announcement, anyone who believes that the preliminary review trademark violates the relevant provisions of the Trademark Law may File an objection with the Trademark Office. 6. Issuance of registered trademark certificate: For trademarks that have been initially reviewed and approved by the Trademark Office and there are no objections within three months from the date of announcement, the registration will be approved, a trademark registration certificate will be issued, and the trademark will be announced.
